The Superior Military Court (STM) accepted the request to judge the declaration of indignity and the resulting loss of official status of former President Jair Bolsonaro (PL) and five other military personnel. In a decision published on Thursday (12/18), the minister in charge of the case, José Barroso Filho, admitted the process and determined that the Office of the Attorney General of Military Justice be officially appointed and express its opinion on the matter.
The complaint was filed by federal deputy Natalia Bonavides (PT-RN). In the request, the parliamentarian mentions that Bolsonaro, Almir Garnier, Augusto Heleno, Paulo Sérgio Nogueira and Walter Souza Braga Netto were convicted by the Supreme Federal Court (STF) for attempted coup d’état.

Analyzing the request, Minister STM emphasized that, generally, the representation is made by the General Military Prosecutor’s Office, but he understood that “the subject in question concerns a matter of relevant public interest, which is why it is clear that the federal deputy is legitimate in provoking the responsible bodies to initiate the procedure.”
“It should be emphasized that the nature of the trial is not intended to revise the already final criminal conviction, but has the specific aim of evaluating the ethical and moral consequences of the conduct that determined the conviction of the officer, in light of the ethical and moral precepts described in the Military Statute. The aim is to determine whether the nature of the crime committed leads to the recognition of indignity or incompatibility with the service of the officers”, added Minister José Barroso.
