The Andalusian Government Council will approve this Tuesday, December 16, the draft decree by which Law 3/2021, of July 26, of recognition of the authority of teachers. The meeting, which usually takes place on Wednesday, is … advances on this occasion so as not to coincide with the plenary session of Parliament.
This is what the agenda, consulted by Europa Press, indicates concerning this project which the Council submitted to the public information process in December 2024 and whose objective is “recognize and strengthen the public authority of teaching staff of the autonomous Andalusian community.”
In turn, encourage their consideration and respectas well as regulate a coverage system that guarantees their protection in the exercise of their functions and powers.
Decree for the educational authority
The draft decree is based on the premise that “having teachers enjoying the greatest possible social prestige, benefiting from institutional recognition for their work and legal support for their authority, is an essential condition”. advance a fair and quality education system, which ensures the climate of respect essential to guarantee the exercise of the educational function, merit and personal effort predominate and educate in coexistence, democratic values and a sense of responsibility.
From the Council, they defend that this decree is “a necessary standard for the implementation of measures that increase and strengthen the social valuation of the teaching function and the authority of teaching staff so that they can exercise their work with maximum guarantees in accordance with the provisions of Law 3/2021 of July 26 mentioned above.
All this “in order to ensure an appropriate climate of coexistence in educational centers, since there is no regulatory alternative less restrictive of rights”, as well as “to establish a stable, predictable, integrated and clear regulatory framework”.
The Council provides that, “in the exercise of their functions”, teachers are recognized, among other rights, that of “respect, recognition and support” to their “authority” on the part of “the students, their legal representatives and the rest of the teachers”, as well as “to adopt rapid, proportionate and effective decisions, in accordance with the rules of coexistence of the school, which allow it to maintain an adequate study and learning environment during classes, in complementary and extracurricular activities, both inside and outside the school premises”.
Other rights recognized for teachers in this bill are those of “collaboration of legal representatives for the respect, by their sons and daughters, of the rules of coexistence”; as well as “to benefit free of charge from legal protection and psychological support in the exercise of their teaching duties”and “the support of the Educational Administration, which will ensure that teachers receive the treatment, consideration and respect that correspond to them according to the social importance of the task they carry out”.
In this sense, the project envisages that “the Educational Administration will provide psychological assistance to teaching staff who provide their services in centers supported by public funds”, as “a service aimed at helping to overcome the impact on teaching staff of attacks or conflict situations that undermine the authority of teachers, in the exercise of their duties, in order to reduce their effect on their health and work performance”.
“The psychological assistance requested by the person concerned will be articulated through the Teacher Support Unit existing in each Territorial Delegation competent in matters of education,” specifies the draft decree.
