
The defense of Renê Nogueira Júnior, arrested for killing street sweeper Laudemir Fernandes in Belo Horizonte on August 11, claims before the Court that the military police officers exceeded their duties and carried out an “unjustified investigation” against the client. The lawyers are trying to overturn the report in which the client is accused of triple homicide, threats and procedural fraud.

According to the defense, the complaint filed against the client was received on the basis of documents “prepared by the military police, which were allegedly produced through improper investigative activity on the part of the company.” The PM would have taken statements, carried out photographic reconnaissance and drawn up a detailed report on the facts, “going beyond their simple operational function and acting as a real judicial police, in violation of the Federal Constitution, especially since it is an intentional crime against life, the investigation of which is exclusively entrusted to the civil police”.
The defense also said that the Belo Horizonte First Jury Court rejected the preliminary investigation “for general reasons.” He asked the court to quash the police report as well as the court ruling dismissing the allegations against the documents.
A request for habeas corpus was rejected on November 18, but the defense appealed and has been awaiting a new analysis since the 28th.
The information was released on Tuesday by the Minas Gerais Public Prosecutor’s Office, which opposed the defense initiative. The deputy maintains that “the simple allegation of nullity does not have the power to characterize it, requiring, for its recognition, the effective demonstration of prejudice and a concrete attack on the rights of the accused, which did not take place”.
The businessman changed his version of events and said that Laudemir de Souza Fernandes could have been the victim of a “faction war”. In newly published extracts from the interview with TV Record, the first since the incident, the executive suggested that the crime could be linked to the activities of drug traffickers in the Cabana do Pai Tomás neighborhood, neighboring the Vista Alegre neighborhood, where the street sweeper died.

Renê said he had previously been approached by armed drug traffickers in the Cabana do Pai Tomás area and said he immediately thought of the possibility when he learned of Laudemir’s death.
— It (the community) is dominated by one faction (TCP), and it’s really very dangerous there. When, at first glance, I saw this (the news of the sweeper’s death), I thought: ‘It was a war of factions’ – underlined Renê, who defended the carrying out of an investigation into this matter.
The businessman was asked why he was armed there. He said that he “and 300 other people” were present and mentioned that witnesses could have identified him as the perpetrator due to financial interests or fear of reprisals from drug traffickers. The expert, however, emphasized that the weapon used in the crime belonged to the police station Ana Paula Balbino, Renê’s wife.
Before discussing the so-called faction war, Renê declared that this affair was an “accident”. He said he decided to shoot into the air after an argument with street cleaners and only learned of the death when he was arrested by police hours later. More recently, he said he confessed to the crime only because he was threatened by agents who allegedly promised to end his wife’s career.
On TV Record, Renê denied opening fire on the waste collection team, but admitted that an “incident” had occurred that day. Laudemir’s colleagues say the executive pulled out his gun and fired after complaining that he wouldn’t be able to drive his car on the road because of the garbage truck passing by.

In the interview, Renê said he had a clear conscience and that lawyers had advised him not to detail what happened.
— I passed by this place. I admit that I was armed. The incident may have happened. As far as I know, through the process, I can admit that an incident occurred, the businessman stressed.
The Court must now decide whether Renê will be tried in court with a jury. The public prosecutor charged him with triple homicide, threats and procedural fraud.
After citing “the incident”, Renê repeatedly denied having participated in the crime. On the date of the crime, he said he said his vehicle would not pass through the space in the street left by the garbage crew and disputed the motivation for the shooting stated by the prosecution, as Laudemir allegedly did not participate in the traffic discussion.
The accused refused to apologize to Laudemir’s family.
— I can’t apologize because I didn’t shoot. I would confess to something that I am not guilty of – he said, calling his arrest “illegal” and citing alleged threats from the deputies.
When asked if he had threatened the garbage truck driver before Laudemir’s death, the executive smiled wryly. Journalist Roberto Cabrini asked him why he smiled and if he found it funny.
– No no. It’s just that I’m thirsty — replied Renê, who said that after the affair he felt that “his life was lost”.
Renê responded to criticism for walking his dogs and going to the gym, where he was arrested, after the Vista Alegre affair. He said he did the activities every day.
During the interview, the executive also regretted not having received a visit from his wife, the delegate of the Civil Police of Minas Gerais, Ana Paula Balbino. The businessman said he did not know if he was still married. Ana Paula’s lawyer said she did not go to see the businessman because there had been a “breakup”.
