The decision of Minister Alexandre de Moraes, in which he orders the preventive arrest of Judge Macário Júdice Neto, of the Regional Federal Court (TRF) 2, provides the chronology of the actions of those investigated which, for the Federal Police, lead to proof that there was a leak in the operation against former deputy Tiego Raimundo, TH Jóias. In addition to the magistrate and the parliamentarian, the dismissed president of the Legislative Assembly of Rio Rodrigo Bacellar is among those targeted by the investigation. Following a request from the Federal Police and the Federal Public Prosecutor’s Office, Judge Macário Júdice authorized Operation Oricalco and ordered the arrest of those under investigation, including the then State Deputy TH Jóias, military police officers and a federal agent, other public officials and drug traffickers. In this investigation, the PF investigates the political branches of Comando Vermelho and names TH as financial operator and coordinator of the faction.

That day, with judicial authorization, around 11 a.m., delegate Samuel Fayad, head of the PF drug repression station in Rio, informed an advisor to Judge Júdice that the police were planning to carry out the operation the next day. He makes contact to ask the magistrate to sign the search and seizure and arrest warrants. The advisor replied that they would be shipped the same day.
In his testimony, Alerj president Rodrigo Bacellar admitted to having been contacted by TH between 11 a.m. and 12 p.m. that day. According to him, TH asked the two men to speak alone and asked if Bacellar knew of any operations against him. The president of Alerj said, in his statement, that he knew nothing, only that there had been “rumors for three days that there would be an operation against an MP and where there is smoke, there is fire.” TH reportedly replied that he did not know if he would run away. Bacellar said in the statement that he did not advise running away: “It’s up to you. If I were in your place, I would only worry about your little girl.”

At 3:45 p.m., the security camera of the TH Jóias condominium, in Barra da Tijuca, captured a movement of people, including the wife of the then deputy, who was transporting objects in a car and leaving the premises. The same thing repeats twice until 6 p.m. An hour later, at 7 p.m., TH arrives home and receives a package at 8 p.m. which for the PF is a new cell phone.
According to Moraes’ ruling, around 9 p.m., Bacellar met the judge at a steakhouse in Rio’s southern zone. At that time, the then president of Alerj informed TH about the operation that would take place the next day.

In a press release, the judge’s defense asserts that “the facts are false and will demonstrate that he acted correctly.” The lawyers also claim that the dinner between Júdice and Bacellar never happened and the security cameras will prove it.
