The Lugo Provincial Court sentences a man to four and a half years in prison for raping a woman who worked at his home to take care of her mother.
The court considers him to be the perpetrator of a continuing crime of sexual assault and rape. In addition to the prison sentence, he will be fined €3,780 and ordered to pay compensation of €10,000.
The judges believe it has been proven that the defendant touched the victim several times without consent and later raped her. The suspect’s defense called for his acquittal on the grounds that the acts were consensual.
However, the court assessed the victim’s statement as “coherent and precise” and at the same time emphasized that it “did not contain any ambiguities, generalities or ambiguities.”
Furthermore, he adds that his story has been “heavy-handed” without “recognizing any contradiction in the substance that diminishes his credibility.” Furthermore, it is ruled out that she was “motivated by a wrong spirit that led her to file a false complaint.”
This statement was also supported by forensic evidence and witness statements, leading the judges to conclude that the defendant acted without the victim’s consent.
The judgment is not final as it can be appealed to the Supreme Court of Xustiza de Galicia (TSXG).
