
The Council of Ministers approved this Tuesday the regulation of Non-payment of rent insurance for owners with young or vulnerable tenantsaid which has not yet received funds and to which the government already gave the green light in January, although it was in the process of being completed. The Executive resumed this measure, agreed with Junts at the beginning of the year, a week after the President of the Government, Pedro Sánchez, recognized the “non-compliance” of the independence party and stressed the need to move forward on this request and on other requests agreed with the party of Carles Puigdemont. The Ministry of Housing assures that the objective of this initiative is to improve access to a roof for the groups most in difficulty.
Public insurance, which will be managed by the autonomous communities, will cover owners who rent their accommodation below the prices of the State reference indexprovided that the tenant is under 35 years old or in a vulnerable situation, in accordance with the corresponding regional regulations. Thus, the monthly rent and the tenant’s profile will be two of the conditions to be able to benefit from this aid, to which is added that the contractual deposit is deposited correctly and that the owner and the tenant have signed the corresponding agreement to take out the insurance according to the model provided by the administration. The autonomous communities may establish additional requirements.
On the owner’s side, to benefit from this assistance, he must be up to date with his tax and social obligations. In the event that the tenant stops paying the monthly rent, the State guarantee guarantees the owner the collection of all monthly payments until he recovers the accommodation, as well as any damage caused by the tenant and the cost of supplies that the owner had to assume. However, the owner will have to wait until the accommodation is empty to claim recovery of these sums and will have a period of six months to request it from the recovery of the apartment, either because an eviction has taken place or because an agreement has been reached with the tenant. In this way, unpaid debts are covered from the first moment, but payment is only made after recovery of the accommodation.
As indicated by the Ministry of Housing, this aid will cover payment defaults on contracts in force from January 30, 2025, given that it was at the end of January that the Council of Ministers approved the bases of this public insurance, whose development regulations had been pending since the end of July. However, the funds with which the guarantee will be financed still need to be approved. From the department headed by Isabel Rodríguez, they assure that “in the near future”, a budget line will be created for this purpose.
In addition to regulating public insurance against possible payment defaults, the Council of Ministers also approved this Tuesday the reconversion of the Public Land Commercial Entity (Sepes) into Casa 47the new public company with which the Government will manage the State’s social housing stock, taking charge of the complete life cycle of the properties, from land development to handing over the keys and managing leases. According to the Minister of Housing, Isabel Rodríguez, this Sunday in an interview with The avant-gardethe Executive plans to invest 13 billion euros in this new entity over the next ten years, at a rate of 1,300 million euros per year from 2026.
The affordable rental contracts promoted by Casa 47 will have an initial duration of 14 years, extendable up to 75 years — with extensions every 7 years as long as access conditions are maintained — and prices that will not exceed 30% of the average income of the area in which the house is located. Families whose income is between two and 7.5 times the IPREM – currently between 16,800 and 63,000 euros per year – will be entitled to it, and it is expected that they will be able to start applying for it from next year via a new online portal.
