
Horacio Rosatti thought on this Monday evening that the Supreme Court of the Nation Ideally, the court should consist of five members and be recognized as the current court “to the limit”. He also emphasized that “with good candidates” it should not be difficult to attract new members.
“This is the opinion of Horacio Rosatti, I do not compromise my colleagues. For me, five is the ideal number, it is the historic number of the court,” said the judge, who has been on the Supreme Court since 2016.
He then explained: “If you form a court of five people, the majority is three and everyone intervenes. Although the first three agree with five, if the fourth does not agree, the file is returned because one of the three can change his criteria.” He also added that the “round” would last longer if there were more members. “It’s like a planet rotating in a longer orbit. For me it would be five” he explained.
The Magistrate also recognized that there is a great institutional responsibility in decision-making and that the number of members sometimes forces them to “make” the editorial boards “compatible”.
“It’s a bit complicated for me because I write a lot of judgments, so how do I make the text compatible with that of a colleague? LN+.

Rosatti also compared the difference in the number of cases the Argentine court has to deal with per year, which he said is about 13,000, with those handled by the United States Supreme Court, which he said does not reach 100. In this regard, he said that work in recent years had been “a lot and very well organized,” although he claimed: “But it has to be said that we are at the limit”.
In this context, he considered that, according to his criteria, only the cases in which he was involved should go to the Supreme Court. “a purely constitutional question”.
In this regard, he emphasized that 2025 will be a record year for the Supreme Court, as the number of sentences it will impose will be the highest since its inception.
Regarding the selection of new judges, Rosatti emphasized that “for very good candidates, there should be no problem in obtaining the two-thirds required for their appointment.”
In this sense, the judge pointed out that the quality of the candidates was very important and stated: “I always put a lot of emphasis on politics, on a certain maturity.” Uncontested, solid candidates make the debate a little more limited and don’t make it that far.
