The government of President Luiz Inácio Lula da Silva (PT) formalizes, this Tuesday (12/9), the regulation of the National Traffic Council (Contran) which facilitates access to the national driving license (CNH) in Brazil. Among the changes is the exemption from compulsory driving school courses to obtain the document.
The initiative, called “CNH do Brasil,” will be launched during an event at the Palácio do Planalto at 10 a.m.
The new rules – proposed by the Lula government – come into force this week, shortly after being published in the Official Journal of the Union (DOU). The publication is expected to take place this Tuesday, after the ceremony in Brasilia.
Last week, Contran unanimously approved the resolution that ends the requirement for a minimum number of courses at driving schools to obtain a driver’s license.

According to the Ministry of Transport, the measure will reduce the costs of obtaining the document by up to 80%. The new model introduces a free digital theoretical course and makes practical courses more flexible by allowing students to be followed by independent instructors.
The ministry highlights that currently 20 million Brazilians drive without a driver’s license due to the length of the process and bureaucracy. Thus, Brazil will no longer be one of the most expensive countries to obtain the document.
During the event at Planalto, the new version of the CNH application will also be launched, now called “CNH do Brasil” — and which will replace the existing application “Carteira Digital de Trânsito (CDT)”.

Changes
Passing the theoretical and practical tests, the medical examination and the biometric collection remain conditions for issuing a driving license.
The candidate can request the opening of the process digitally, via the website of the National Traffic Secretariat (Senatran).
Free theoretical course
Once the file is completed, the student moves on to the theoretical stage, which will no longer be exclusive to driving schools. With this change, it will no longer be mandatory to take 45 hours of courses.
The candidate can also prepare for the theoretical exam as they wish.
There will be the possibility to follow the course online And free offered by the Ministry of Transportation, in addition to studying in traditional driving schools, in person or remotely, or opting for public traffic schools (such as Detran) or other accredited institutions.
After completing the theoretical course, you must complete the biometric collection – which includes photo, fingerprints and signature – at the Detran of the state where you reside and undergo medical examinations. Planning for the psychological assessment and physical fitness examination must be done with Detran, in clinics accredited by the agency.
Practical lessons
Another big news: the minimum number of hours for practical driving lessons will drop from 20 hours to just two hours.
From now on, students will be able to hire independent instructors, not linked to driving schools, for practical lessons. Driving schools will continue to exist, but now the service they provided exclusively will no longer be mandatory, thus offering more freedom to the consumer.
The vehicle used in class can even be made available by the traffic instructor or by the candidate himself.
To act autonomously, the monitor must meet certain requirements. They are:
- Minimum age 21;
- Have at least two years of driving license;
- Absence of very serious recent offenses;
- High school diploma;
- Have a certificate of a specific course carried out by the traffic executive body;
- Not having suffered the penalty of driving license revocation.
Toxicological examination for categories A and B
- Another change concerns the toxicological examination. It will remain mandatory for category C drivers (cargo vehicles); D (transport of people) and E (trailers and articulated vehicles). But what is new is that this approach will also be necessary for the categories A (motorcycles) And B (passenger cars).
- The new rule was established after the National Congress overturned President Lula’s vetoes last Thursday (12/04), including the text that exempted the mandatory test for car and motorcycle drivers. From now on, the measure is valid for all CNH categories.
- According to the National Road Traffic Secretariat (Senatran), the toxicological examination required to obtain the document is an examination with a wide detection window, aimed at verifying the consumption, active or not, of psychoactive substances up to 90 days before the procedure.
- The procedure is performed using a sample of keratin, which can be hair and/or fur. In the absence of these, this can be achieved with the nails.
- The test is carried out by laboratories accredited by Senatran.
- The Brazilian Highway Code (CTB) prohibits public entities from setting prices for scheduled examinations; prices are therefore defined by free competition.
- To justify overturning the veto, parliamentarians estimated that requiring an examination would increase the cost of the first license between R$110 and R$250.
Evidence
The theory test remains mandatory and must be scheduled with the state transportation agency. The exam can be taken in person or online, depending on the structure of the local Detran.
To obtain approval, you must answer at least 70% of the questions correctly. Those who fail can retake the test as many times as necessary.
The practical exam also remains mandatory and must be scheduled through channels provided by Detran, who will also evaluate the candidate’s performance.
