
The legislative initiatives that promote the partial return of deposited funds Office for Pension Normalization (ONP) have caused a stir in the Peruvian Congress by proposing to allow affiliates to leave up to 50% four control units (ITU)Total equivalent to S/21,400. The aim of the proposal is to allow exceptional access to the funds originally intended to secure a pension.
However, this debate took a turn in April 2025 when the Labor and Social Security Commission addressed two of the projects presented. After review, these were reformulated, departing from the original idea of withdrawal for all contributors. The preliminary ruling now provides for the granting of a special bonus of up to ITU room (um S/1,337.50), focused exclusively on ONP members diagnosed with terminal illnesses or chronic illnesses.
This judgment The journey to the plenary session took so longthat other congressmen continued to submit draft legislation confirming the withdrawal of the ONP, even though the labor commission had already decided on the matter. Seven months have passed since April and ten more projects have been added that are demanding this reimbursement of contributions to the ONP.

The measure of withdrawing contributions to the ONP was proposed in two draft laws, but these were passed by the Labor and Social Security Commission at the time and were re-examined given the high fiscal costs and also because the Constitutional Court had previously ruled on a similar measure and declared it “unconstitutional”.
The text says: “The greatest interpreter of the Magna Carta declared unconstitutional by the content and form of Law 31083, a law establishing a special optional regime for the refund of contributions for active and inactive contributors in accordance with the Law Decree Law 19990 The law administered by the Pension Normalization Office (ONP) could therefore conflict with the regulation contained in Decision 151-2021.”
For this reason, the ONP withdrawal measure could not be approved, or if approved, it would overcome this obstacle and not take effect. Instead, the decision separated the ONP pension and proposed the payment of a quarter of the UIT as a special benefit for contributions of less than ten years in the National Pension System for the benefit of older adults with chronic degenerative diseases or terminal illnesses. As is well known, this corresponds to S/1,337.5 in 2025.

Amid this delay in the debate on this issue, other ONP withdrawal projects were added that were not discussed in either the Economic or Labor Commission. These are the following:
- Bill authorizing the extraordinary withdrawal of up to 4 UIT (S/21,400) from ONP funds
- Bill which exceptionally grants SNP members a corresponding bonus of up to 2 UIT (S/10,700): This is called differently but is similar in spirit to an ONP payout.
- Bill authorizing the extraordinary withdrawal of up to 4 UIT of funds deposited to the ONP
- Draft bill authorizing the extraordinary and voluntary deduction of funds paid into the ONP of up to 5 UIT and providing for an increase in the retirement pension of those insured under the SNP
- Bill that provides for the extraordinary and voluntary withdrawal of funds contributed to the ONP of up to 4 UIT and provides for an increase in old-age pensions for the benefit of Peruvian families in order to contribute to the economic reactivation of the country
- Law allowing the extraordinary deduction of up to 2 UIT of contributions to the ONP and providing for a gradual increase in the maximum old-age pension
- Law providing for the exemption from contributors and former contributors to the ONP for the voluntary deduction of up to 5 UIT of their funds
- Law allowing, exceptionally, the optional withdrawal of up to 4 UIT of contributions to the ONP and establishing other measures
- Law authorizing the extraordinary and voluntary deduction of up to 5 UIT from its resources for contributors and former contributors to the ONP in the context of the economic recession
- Law authorizing the extraordinary and optional deduction of up to 4 UIT of its resources for contributors and former contributors to the ONP.
