
The Constitution and Justice Commission (CCJ) of the House canceled, this Wednesday (12/10), the opinion of rapporteur Diego Garcia (Republicanos-PR) for the maintenance of the mandate of federal deputy Carla Zambelli (PL-SP). The report, which stated that there was “insufficient evidence” to convict the Bolsonarista of invading the National Council of Justice (CNJ) system, received 32 votes against and 27 for. Now, a new report must be presented and voted on.
In August, Zambelli was sentenced by the first chamber of the Federal Supreme Court (STF) to 10 years and eight months in prison and loss of office. The decision was based on the parliamentarian’s participation in the insertion of false documents on the CNJ platform carried out by the hacker Walter Delgatti, who allegedly acted at the request of the Bolsonarista.

Italian justice asks Moraes for information on Zambelli arrest
Zambelli, imprisoned in Italy after fleeing to the country of her nationality, followed the session remotely. His son and his lawyer also followed the vote. During the session, she asked deputies to vote against dismissal “in the name of the true independence of the powers.” She is awaiting the Italian government’s decision regarding her extradition.
The final decision, however, rests with the Plenary Chamber. The President of the House, Hugo Motta (Republicanos-PB), guided the process of Wednesday’s session. The dismissal of Glauber Braga (PSol-RJ) will also be analyzed. The Paraíba deputy reported that the impeachments of Alexandre Ramagem (PL-RJ) and Eduardo Bolsonaro (PL-SP) would still be analyzed.
Last week, Garcia presented an opinion opposing the parliamentarian’s impeachment because it was “not certain” that she committed the crime for which she was convicted. A collective point of view was accepted and members of the government base presented objections. PT leader Lindbergh Farias (RJ) submitted a writ of mandamus against the proceedings before the CCJ.
This Wednesday, Garcia presented a new opinion in which he refutes the opinion of the government’s supporters and maintains the decision in favor of Zambelli. To journalists, he repeated that Bolsonaro’s deputy had been convicted without evidence, criticized the case’s rapporteur at the Supreme Court, Alexandre de Moraes, and said his decision was aimed at defending the parliamentary mandate.
“And therefore, ladies and gentlemen parliamentarians, because there is a deep, serious and legitimate doubt, this rapporteur votes to reject the representation, to preserve the mandate of Deputy Carla Zambelli and, above all, to defend the sovereignty of the popular vote and the primacy of the legislative power of the Federative Republic of Brazil,” concludes the vote.
Maneuver
Before this Wednesday’s session, União Brasil changed some members of the CCJ. The move was seen as a maneuver aimed at forming a majority and paving the way for Carla Zambelli’s exclusion from the commission. Members of the PL criticized this decision. The union recommended against the report.
At the commission, Zambelli’s lawyer Fábio Pagnozzi said parliamentarians had voted “in their own interest.”
“What I see is that many are not voting to say whether the MP is guilty or innocent, but rather out of personal interest to be able to occupy their seat. The exchange of members of a certain party seems dark to me,” he said.
The maneuver is seen as a nod to Hugo Motta to unblock the impeachment process in order to reach the plenary. The interlocutors believe that the accumulation of deputies with legal problems and who are outside the country has become a problem and a source of stress for the Speaker of the House.
