The First Section of the Contentious-Administrative Chamber of the Superior Court of Justice of Castile-La Mancha accepted the appeal presented by an official of the Provincial Deputation, currently personal delegate of the USO union, and declared the nullity of … procedure followed to modify the List of Jobs corresponding to the 2022 financial year.
With this judgment, the Court revokes the resolution of the Contentious-Administrative Court number 1 of Cuenca, which in 2022 had approved the agreement approved by the plenary session of the provincial institution.
The sentence, provided by the union, indicates that The procedure is canceled due to the absence of the obligatory report from the Secretariata report “which is mandatory in all procedures for approval or modification of the RPT, since it is a mandatory legal opinion”.
According to USO, the Chamber considers that the report of the human resources director “cannot replace this function”, and emphasizes that “the omission of this procedure constitutes a essential disabling defect “which prevents us from evaluating the rest of the allegations made by the applicant, because it would anticipate the analysis that corresponds to the Secretariat in its report.”
The union also emphasizes that the Court emphasizes the “economic implications” of the decisionreason why it is common and entirely appropriate to have an intervention report, the body responsible for financial control and internal inspection.
USO says it has no intention of ‘prolonging the conflict’ and expresses his desire to collaborate with the Provincial Council to find solutions “that benefit both parties and allow us to move forward constructively”.
The union specifies, however, that for this cooperation to be possible it considers it essential “that there be total transparencygood faith and fluid communication on the part of the Provincial Council. He says he is open to dialogue and willing to work together “always within a framework of clarity, responsibility and mutual collaboration”.
