
The Supreme Court upheld the sentences of between 20 and 24 years in prison imposed on the three people convicted of the murder of Samuel Luiz in La Coruña in 2021 and claims that the attack consisted of an “inexplicable lynching”.
The Criminal Chamber of the TS also maintains the decision of the Superior Court of Justice of Galicia of acquitted for lack of evidence to a fourth accused who had been found guilty of complicity by the Provincial Court.
The magistratess appeals are rejectedboth the defense of the three convicted persons as well as the prosecution and the private prosecution, the latter against the acquittal of the fourth accused.
“Was a surprise attack (the previous interaction was purely anecdotal due to the insignificance of the alleged offense), which leaves the victim defenseless from the first moment, in a sort of inexplicable lynching,” the Court indicates in this regard.
