The Criminal and Civil Chamber of the Superior Court of Justice of Andalusia confirmed the 17 years in prison for the man accused of stabbing his pregnant ex-partner in the abdomen in Palm Tree Fountain in a sexist attack … only partially admitting a defense appeal by which the civil liability required of the author of these crimes in this criminal procedure is eliminated.
The judgment provided by the TSJA indicates that on May 23, 2025, a judgment was rendered by the Third Section of the Provincial Court of Córdoba, whose proven facts show that the accused, Pablo P., had maintained a relationship sentimental with the victim between October 2022 and October 2023. The couple had resided in various localities such as Écija, Granollers, Torrevieja and Fuente Palmera, with the injured party deciding to end the relationship and go to live with their maternal grandparents in Fuente Palmera.
The accused, continuously since the beginning of the relationship and while he lived with the victim in the different houses, on several occasions, made her the object of humiliation and demeaning insults such as “bitch, bitch, I don’t want the child because it comes from a whore…”, showing emotional indifference towards her and sending her multiple threatening messages by telephone, also implementing coercive mechanisms that isolated her socially and family, given that the accused did not let her go out alone or work for fear that she would associate with other men.
He also didn’t want his partner interacting with his family, having no one visiting them at home, controlling his life. social networksclothing and personal image, which led to numerous discussions motivated by jealousy, including slapping him once without a date being specified.
The sentence, now confirmed in its main terms, includes the most serious episode where, in the early hours of December 7, 2023, the defendant sent his ex-partner, 28 weeks pregnant and residing with his grandparents, about 100 messagesin which, with the intention of intimidating her, he said to her: “I’m in Fuente Palmera, on the street where your grandparents live, if you don’t come out and talk to me, come into the house and make a mess. you if you’re going to piss me off there….. You’re going to find yourself without grandparents… I’m capable of anything….. why am I killing her, I swear I’m killing her….. It means going to prison but both of them are dead and the first is your grandmother.
Finally, that day, at midday, the young pregnant woman decided to go out to talk to the defendant, both heading to a nearby park to chat. Pablo insistently asked her to resume the relationship, which she refused, telling him that what she wanted was to live in peace with her grandparents. In this way, and given his poor anger management, the defendant took out a knife and brandished it in front of him in a threatening manner without saying anything. He also asked her to spend the night together in a local hotelfor which the victim needed his ID. Under pressure from him, she went to her grandparents to take him because she did not have him with her.
He gave Grandpa a helping hand
Once the couple arrived near their grandparents’ home, EM RR’s grandfather left his home and reproached the defendant for his presence in the city. Pablo, with the intention of harming the physical and bodily integrity of his ex-partner’s grandfather, walked towards him and pushed him. It is then that the young pregnant She reproached the defendant for his behavior, both going to the street of local doctors to continue talking at the request of Pablo who returned insistently to ask her to go live with him in Cordoba, refusing again.
Pablo P., after turning around and pretending to send a message to a family member to come get him, without saying a word, surprisingly, thus preventing her from being able to defend herself, he walked towards her, and with the intention of ending his life and that of the fetus, he took the knife out of his pocket and he stuck it in the stomach without achieving his goal for reasons beyond his control, leaving quickly.
The court considers that the accused committed this crime against him simply because of being a woman and with absolute disregard for her condition. Following the events, the young woman suffered injuries for which she claims the following injuries: abdominal wound due to a knife and a 28-week pregnant woman, wound of approximately 1 cm in the epigastrium 10 cm from the fundus of the uterus. They had to wait for the fetus’s respiratory system to mature with the medication. On that day, December 7, 2023, she was operated on and her condition was serious, so she did not report to the department until December 15, 2023.
Today the High Court of Andalusia confirmed the extremes which criminally sentence the accused to two years and six months in prison for habitual physical and mental abuse, ban for four years carrying a weapon, ban on approaching the victim; in addition to a year in prison for minor threats of domestic violence.
There is no room for a mistrial
As the perpetrator of a minor offense of mistreatment at work sentenced to a three-month fine with a daily allowance of 15 euros, and as the perpetrator of an offense of murder in degree of attempt and abortion for the degree of attempt, with the aggravating circumstances of sex and mixed parentage in both crimes, 11 years in prison, an additional three years for the offense of abortion as well as ten years of restraining order against his son.
The reasons given by the decision to withdraw civil liability and which do not take into account no case of mistrial are that this request was presented at the time of the oral trial, not before, and was also not included in its classification by the prosecutor, which could lead to impotence only in this aspect of civil liability.
