In October this year, a São Paulo court rejected the request for preventive detention of military police officers Guilherme Augusto Macedo and Bruno Carvalho do Prado who killed the student, after a demonstration also held by the São Paulo Public Ministry against the arrest.
According to Judge Luciana Menezes Scorza’s decision, “there is no new fact that would lead to the order of pretrial detention” of the two police officers. The judge also denied the use of electronic monitoring (ankle bracelet) for the defendants, as there is nothing in the records indicating that they did not adhere to the precautionary measures.
Progress of the process
It has not been determined whether the defendants, Guilherme and Bruno, will be tried before a jury court or not. Now, both parties will present their final arguments in writing, and after completing this stage, the decision will be made in the jury.
The Public Security Secretariat reported that the case was investigated by the Department of Homicide and Personal Protection (DHPP), which referred the police investigation to court. The Ministry also stressed that one of the police officers involved has already been charged in the Prime Minister’s investigation for premeditated murder and remains away from the activities.
According to MPSP, the files will soon be available for the panel’s final arguments. The Public Prosecution said: “Until now, there is no new fact that could justify the addition of the complaint, nor any change in the state of the defendants’ freedom, as the Public Prosecution of Appeal rejected the Public Prosecution’s appeal and reserved the temporary freedom of both of them, while the appeal submitted by the Assistant Public Prosecution is still awaiting trial.”
A medical student was killed by the Prime Minister
Marco Aurelio Cárdenas Acosta was 22 years old when he was killed after a military police officer shot him at close range as he approached inside a hotel in Vila Mariana, in the southern region of São Paulo.

The student managed to free himself when another police officer, Private Bruno Carvalho do Prado, appeared and kicked him. The young man grabs the Prime Minister’s foot, who loses his balance and falls backwards. At that moment, Prime Minister Augusto shot Marco Aurelio.
In the police report, police claimed Marco Aurelio Cardenas was “very upset and aggressive” and resisted police approach. Moreover, the document indicates that “at a certain point, he (Marco Aurelio) attempted to steal the firearm that Private Prado was carrying, when Private Augusto fired a single shot, in order to stop him.”
However, photos of the hotel’s inner circle show that Prime Minister Augusto fired after Private Prado kicked the student, grabbed his leg and fell backwards, off balance. In the video, Marco Aurelio cannot be seen trying to grab the agent’s weapon – contrary to what was said at the police station.
According to the Public Security Secretariat, before the moment recorded at the hotel, the student “hit the police car and tried to escape.” The Ministry also informed that the Prime Ministers made a statement, have been charged in the investigation and will remain away from operational activities until the investigations are concluded – the case will be investigated by military and civilian police.
Furthermore, the Supreme State Security Prosecution stated that images recorded by body cameras were attached to investigations conducted by the Internal Military Police and the Department of Homicide and Personal Protection (DHPP), although the information did not officially appear in the police report.
