
The First Chamber of the Supreme Federal Court (STF) analyzes this Friday (12) the decision of Minister Alexandre de Moraes who decreed the loss of the mandate of federal deputy Carla Zambelli (PL-SP). The trial will take place in a virtual plenary session from 11 a.m. to 6 p.m.
The session was scheduled by the minister Flavio Dinoclass president. Besides Moraes, ministers Cristiano Zanin and Cármen Lúcia are also on the board. In this type of trial, judges vote in the system, instead of arguing the case in person.
On Thursday (11), Moraes overturned the decision of the Chamber that maintained Zambelli’s mandate. He decreed the immediate indictment of the parliamentarian and ordered Hugo Motta (Republicanos-PB), president of the Legislative Chamber, to take office as deputy of the parliamentarian within a maximum period of 48 hours. Adilson Barroso (PL-SP) must take a stand.
The MP is imprisoned in Italy awaiting the outcome of extradition proceedings. She was sentenced by the Supreme Court to ten years in prison for intrusion into the systems of the National Council of Justice (CNJ). Moraes had already ordered the dismissal of the parliamentarian, but the Chamber decided on Wednesday (10) to maintain Zambelli’s mandate.
Zambelli was convicted in May of hacking CNJ systems. According to the decision, she acted by including a false arrest warrant against Moraes and a release permit in favor of a leader of the Comando Vermelho. For this, falsified credentials of agency employees were used.
Despite the final and unappealable conviction and the fact that Zambelli did not carry out his duties due to his imprisonment, the House decided on Wednesday to uphold the mandate. The score was 227 to 179 for revocation. The result, however, fell short of the 257 votes that would be needed to determine loss of the mandate.
