
The 1st Specialized Section of the Federal Regional Court 2nd Region (TRF2) maintained the arrests of former state deputy Tiego Raiumundo dos Santos, TH Jóias, and four other people accused of being part of the political core of Comando Vermelho in Rio. This was the first session after the arrest of the file’s former rapporteur, Macário Júdice, who was arrested this week on suspicion of having disclosed the operation. The judges have not decided whether or not to accept the complaint against the former deputy, a fact which will be analyzed in another session.

According to g1, the board of directors decided to dismember the action, which had 14 defendants. Those accused of belonging to the political core and the most important members of the action will be tried at the TRF: in addition to TH, this group includes drug trafficker Luciano Martiniano da Silva, Pezão, Gabriel Dias de Oliveira, Índio do Lixão, former parliamentary advisor Luiz Eduardo Cunha Gonçalves, lawyer and former secretary Alessandro Pitombeira Carracena and federal delegate Gustavo Steel. The others will see the action referred to the 6th Federal Criminal Court.
The judges also authorized the federal police to use the two armored vehicles and the two drones seized during the operation.
After the arrest of Judge Macário Judice Neto, this Tuesday, by the Federal Police, another magistrate took over the case of Tiego Raimundo dos Santos Silva, known as TH Jóias, which is being processed at the Regional Federal Court of the 2nd Region (TRF2). Júdice Neto is under investigation by the PF on suspicion of leaking confidential information from an ongoing investigation against the former MP, identified by police as a political wing of Comando Vermelho. With the dismissal of the magistrate, the case began to be reported by Judge Julio Cesar de Castilhos Oliveira Costa, who served as Judice Neto’s examiner. He took up his position in June this year, after a position opened.
Before becoming a judge at TRF2, Oliveira Costa worked at the Federal Public Ministry (MPF) in Espírito Santo. He joined the Court of Rio de Janeiro after the retirement of a judge, after being the most voted by the plenary of the TRF2 to compose the triple list formed by the members of the MPF.
According to TRF2, Oliveira Costa is the second Black person to hold a federal judge seat on the court. He holds a law degree from the State University of Rio de Janeiro (UERJ) and a master’s degree in constitutional law and procedural law.
The magistrate served as Attorney General of the Espírito Santo Public Prosecutor’s Office between 2015 and 2017 and also headed the state’s Electoral Public Prosecutor’s Office, from 2021 to 2023.
After the dismissal of Macário Judice Neto, the judge’s office began to be occupied by the summoned federal judge Marcelo Leonardo Tavares. He was appointed on Tuesday by the president of TRF2, federal judge Luiz Paulo da Silva Araújo Filho.
The session takes place this Thursday
The TRF2 session which will deal with the receipt of the complaint against TH Jóias is scheduled for this Thursday. The hearing will be presided over by Federal Judge Wanderley Sanan Dantas and will have eight members. The session is scheduled for 1 p.m.
The dialogues reveal the close relationship between the judge and Bacellar
Conversations obtained during the Federal Police investigation show that Judge Macário Judice and Rodrigo Bacellar maintained close friendly relations. In several posts, the two called each other brothers and talked about their personal lives. There are also dialogues in which they ask for favors and discuss personal disagreements.
In one of the messages obtained by the police, the magistrate requests tickets for Flamengo’s match against Ceará, played in November this year, for the Brazilian Championship.
According to the intercepted messages, Bacellar responded that he would do his best to comply with the request. “Even if I break down the gate, I will find a way. I have common sense, my godfather,” he wrote, in a conversation followed by the PF.
Exchanges recorded on messaging apps also include declarations of affection and loyalty, such as “you are a brother for life”, “I love you” and “I will take you to the coffin, brother”. For researchers, the content of the dialogues testifies to a personal proximity and mutual trust between the judge and the politician.
Rodrigo Bacellar was arrested on the 3rd. The arrest was ordered by Alexandre de Moraes in the first phase of Operation Nail and Flesh, which also targeted the actions of public officials involved in the leak of confidential information from the investigation that arrested TH Jóias. He was released on the 9th, a day after members of the Rio Legislative Assembly (Alerj) voted to revoke the arrest of the Speaker of the House.
