The Civil Guard of Teruel opened an investigation in Guadalajara for a crime of homicide due to the serious recklessness of a driver, who tested positive for drugs after a road accident on October 29 that cost him his life … to another driver on the A-2708 highway near the municipality of Teruel, Orihuela del Tremedal.
The road accident consisted of a head-on collision due to the partial invasion of the opposite lane by the truck, Benemérita reported.
The driver investigated gave a positive result to the indicative drug testwhich was later confirmed by an official laboratory.
The other driver involved was seriously injured and was therefore evacuated by helicopter to the Miguel Servet Hospital in Zaragoza, where he was admitted to the intensive care unit (ICU), dying a few days later due to the severity of his injuries.
The offense of homicide for serious recklessness, included in article 142 of the Penal Code, provides that the driver indicted may be sentenced to a prison sentence of one to four years, a fine of 6 to 24 months and deprivation of a driving license for three to six years.
Furthermore, drug use while driving is a very serious offense listed in the General Highway Code and punishable by a fine of a thousand euros, the loss of six points driver’s license and, if proven to be driving under the influence of narcotic substances, they could also face “serious legal consequences.”
