
Two women who worked as employees of the cleaning service from a clinic in Benidorm (Alicante) were sentenced to six months in prison for humiliate and mock regularly from a colleague who suffered from achondroplasia, which they called “the dwarf”.

They also convinced an acquaintance to call him. threatening tone, warning of his intention to inform his manager that he had seen her shopping during working hours and adding “vexatious expressions due to her disability as if she and her partner were “hybrids” and a “small” person.

This treatment manifested itself in the workplace, where the accused “committed various acts of humiliation, such as habitually referring to her as “the dwarf” and making “mocking comments and insinuations regarding his disability.”
This continued behavior led the victim to come forward with leads complaints in front of the National Police in 2021 but those who were now condemned alleged that their behavior It was limited to simple jokes and they expressed regret if they had caused any damage.
In a judgment subject to appeal before the Superior Court of Justice of Valencia (TSJCV) in ten days, the court considers, regarding the alleged jokes, that ““cannot be sustained” this argument “because of the anonymous nature of certain incidents and their repetition over time, this is why anyone who has been a victim of such a situation perceives a feeling of persecution, harassment and vigilance with regard to his person.
