
THE Second Chamber of the Federal Court (STF) unanimously maintained the decision of the Minister Kássio Nunes Marques who suspended the remoteness of Wanderlei Barbosa (Republicans) from the position of governor of Tocantins. The politician was dismissed from office in September by decision of the Superior Court of Justice (STJ). He is investigation by the supposed misuse of parliamentary amendments intended for the purchase of food during the covid-19 pandemic.
Nunes Marques, rapporteur of the process, followed by ministers André Mendonça, Luiz Fux, Dias Toffoli and Gilmar Mendes. The virtual analysis started on Wednesday (10) and ends this Thursday (11).
Nunes Marques understood that the removal measure was “excessive” and that the investigations did not demonstrate that the governor represented a real and present risk to public order or the process. The minister insisted on the need to deepen the investigations, before taking a restrictive measure.
Wanderlei Barbosa is under investigation for alleged crimes of tender fraud, asset laundering and criminal organization. According to the findings, the core of the project would revolve around the Secretariat of Labor and Social Development, politically attributed to Barbosa when he was vice governor.
The investigation targets alleged fraud in the supply of basic food baskets and frozen chickens between 2020 and 2021. According to the PF, the fraudulent contracts worth more than 97 million reais generated losses of more than 73 million reais for public coffers.
In a statement, Wanderlei said the STF’s decision allows “the government to continue to carry out its work with stability and seriousness.” “My duty is to ensure that Tocantins has current management, responsible decisions and continuity of public policies. We will continue to lead the State with transparency and focusing on what is priority,” he concluded.
