Victor Fasano decided to bring the debate on image rights to the legal field and targets TV Globo thanks to the new exploration of “O Clone”, a hit written by Glória Pérez in 2002. In an exclusive conversation with this columnist from Metropolisesthe actor explained why he filed a complaint against the channel and detailed what he considers to be irregular in the rebroadcast of the soap opera. According to him, the problem does not come from the past.

“Globo has always paid me everything normally, always. Of course, according to the image contracts previously signed with each professional. However, since Canal Viva/Globoplay Novelas and streaming, there is no payment for the use of my image or that of any other actor. This use was never intended before.”
Fasano also said that if there was any new commercial exploration, there would be a new bill to pay.
“This should therefore generate a new payment, because a new commercial exploitation without payment to the artists is unfair. It is important that this is clear. They are using the images of all the actors on these new platforms without even asking permission from those who hold the image rights.”
The Chronicle contacted TV Globo for comment on Victor Fasano’s statements, but at the time of publication had not received a response. The space remains open.
Understand the case
Details of the process were published by Metropoles columnist Fábia Oliveira. The investigation reveals that the actor and the company Paisagio Comércio Vídeo Foto, of which he is a managing partner and which has signed a contract with Globo, claim that the rebroadcasts of “O Clone” are taking place without the expected transfers. The suit was filed in June of this year.
The defense thesis is that the initial contract did not provide for the exploitation of the work in streaming (in this case Globoplay). The prosecution maintains that the channel continues to profit from the soap opera without passing on the amount corresponding to the use of the actors’ images.
In court, Victor Fasano and Paisagio demand that Globo be ordered to pay rebroadcast rights on Globoplay and Canal Viva. They are also seeking a contractual fine for the alleged violations of the agreement as well as compensation for moral damage.
