The government, through a decree signed by President Javier Milei and Chief of Staff Manuel Adorni, ordered the granting of administrative leave to the staff of the National Public Administration on December 24 and 31, 2025.
The measure, published this Monday in the Official Journal, aims to facilitate family preparations and travel on the eve of Christmas and New Year celebrations, dates that Argentine legislation recognizes as immovable national holidays.
Who doesn’t work on December 24th and 31st?
The decree is based on Law 27,399, which establishes December 25th and January 1st as national holidays, as well as the social and family nature of these celebrations.
According to Decree 883/2025, “such dates have a deep-rooted cultural, social and family significance for the Argentine population and for those living in the territory of the Argentine Republic, and traditionally represent an occasion for reunification, celebration and rapprochement between family and loved ones.”

The decree also indicates that the measure will have a positive impact on the tourism sector by favoring domestic travel and the use of days off for leisure activities. In addition, it clarifies that the holiday does not entail any additional costs for the nation-state and that “it guarantees that all Argentines can enjoy the holidays in a framework of freedom.”
As for the scope of the provision, Article 1 establishes that the holiday applies to national public administration staff, while Article 2 directs the various organizations to take the necessary measures to ensure the continuity of essential services. Article 3 stipulates that the measure does not affect banking institutions or financial institutions, so these sectors must function normally during the above dates.
Since December 24th and 31st are public holidays, employees cannot perform their duties for two consecutive days, since December 25th and January 1st are non-removable holidays, so staff required to work on these days are paid twice.
In the case of the private sector The situation will be different, as each employer can decide whether to give their employees a day off.. In this case, if the company decides not to work, that day is not a holiday, so no additional payment is generated. According to current regulations, December 24th and 31st are common working days, so those who work receive standard pay unless your company provides otherwise.
The decision was made in exercise of the powers conferred on the executive by Article 99(1) of the State Constitution.
