The Supreme Court overturned an attempt by the Chamber of Deputies to keep the parliamentarian, sentenced to 10 years in prison for hacking the CNJ system. Italian justice will judge the extradition. The Chamber of Deputies announced this Sunday (14/12) that federal deputy Carla Zambelli (PL-SP) resigned from her mandate. The communication was sent to the Board of Directors of the House.
With the resignation, the President of the Chamber, Hugo Motta (Republicanos-PB), must swear in this Monday the deputy of the parliamentarian, Adilson Barroso (PL-SP).
Zambelli left office two days after the Federal Court (STF) confirmed his immediate dismissal.
Friday (12/12), the First Chamber of the Supreme Court unanimously confirmed the decision of Minister Alexandre de Moraes to annul a vote of the Chamber of Deputies which had maintained the mandate of the parliamentarian.
The House rejected Zambelli’s impeachment by 227 votes in favor and 110 against. It took 257 votes to lose the mandate.
For Moraes, the parliamentarians’ decision is unconstitutional. According to him, the Constitution defines that it is up to the judicial power to determine the loss of the mandate of a convicted parliamentarian by a final and final decision, with the Chamber being solely responsible for “declaring the loss of the mandate”.
Zambelli was sentenced by the STF to 10 years in prison for hacking the electronic system of the National Council of Justice (CNJ), in 2023. According to the investigation, the hack was carried out by Walter Delgatti Neto, who is a confessed defendant.
Italian court to decide on extradition
In July this year, Zambelli was arrested in Rome, Italy, where she was attempting to evade the execution of an arrest warrant issued by the STF. Because she has dual nationality, the MP left Brazil in search of political asylum.
The final decision on the extradition procedure carried out by the Brazilian government will be made at a hearing in an Italian court next Thursday.
The European country’s public prosecutor’s office has given a favorable opinion for extradition, but the MP’s defense claims that the arrest is politically motivated.
In August, she was sentenced again, this time to five years and three months in prison for the offenses of illegal possession of a firearm and unlawful restraint using a firearm.
