Expected to be released this Thursday (1/1), the defense of former President Jair Bolsonaro (PL) asked him to stay in the hospital and not return to the Superintendence of the Federal Police (PF), in Brasilia, where he is serving a sentence for attempted coup d’état.
The request was presented to the Federal Court (STF) by lawyers in the early hours of the New Year. In the document, the defense requests that Bolsonaro remain in the hospital while the rapporteur of the file, Minister Alexandre de Moraes, does not comment on the request for humanitarian house arrest already filed.
“Jair Messias Bolsonaro, already qualified in the aforementioned case, by his lawyers to which he subscribes, respectfully comes in the presence of Your Excellency, to request that, pending the examination of the request for humanitarian house arrest already filed, he be assured of remaining in the hospital where he is currently admitted, thus avoiding his transfer to the prison before the final decision on said request is made,” the lawyers wrote.
The defense continues: “The request is justified taking into account the recent and still evolving clinical picture, as well as the postoperative complications recorded, which require continuous and monitored medical surveillance, a circumstance which recommends the temporary retention of the patient in a hospital environment until the conclusion of the judicial analysis.”

During a press conference held on Wednesday (12/31), doctors informed that the planned discharge is for this Thursday, without indicating a time.
According to surgeon Cláudio Birolin, Bolsonaro underwent an upper digestive endoscopy on Wednesday morning. This is the fifth medical intervention since his admission to the DF Star Hospital, in Brasilia, which took place on Wednesday (24/12), Christmas Eve.
THE Metropolises found that the new request from the defense takes into account the possibility for the rapporteur to request an opinion from the General Prosecutor’s Office (PGR) on the request for humanitarian house arrest, which could, in theory, extend Bolsonaro’s stay in the hospital, even with his expected release.
To date, Moraes has not yet analyzed either of the two requests presented by the defense.
