The notice from a team of State Department of Culture officials says inspection work was blocked at a Gardens home and they heard reports that more than 100 people continued to work at the site, even after other inspections found irregularities in the work.
The document, emanating from the Directorate for the Preservation of Cultural Heritage, is part of a move by the Association of Garden Residents (AME Jardins) against the work in the home of billionaire João Adibe, CEO of the pharmaceutical company Cimed.
As revealed Metropolisesthe Court imposed an embargo on work on his mansion in Jardins and vetoed the grant of habitation for the property. Adibe’s defense, in turn, said the work was authorized by all relevant agencies and was completed months ago.

The construction of a mansion of pharaonic proportions in Jardim Paulista, one of the most expensive neighborhoods of São Paulo and with several urban restrictions, provoked the revolt of the wealthy neighbors.
The person responsible for the construction is the businessman João Adibe (featured photo), president of the pharmaceutical company Cimed and 86th richest man in the country, with an estimated net worth of 5.2 billion reais, according to Forbes magazine. In recent months, Adibe has also started to frequent sports news, cited as a possible future president of Palmeiras.
The Gardens district is classified as a Condephaat state heritage site. Therefore, following complaints, a team of architects and lawyers from the state’s cultural sector visited on August 5 to verify reports of irregularities in the property.

Despite a prior meeting with the owner’s lawyer, “when we arrived on site, we were not authorized to enter the property,” reports the Opinion. The officers therefore went to the neighbor’s house, where they managed to photograph a small building on the grounds of the mansion which, in the team’s opinion, exceeded the maximum height allowed for the Gardens area.
“On this occasion we also verified that despite the embargo on the works, the embargo is not respected, we asked the workers three times how many people were working on the Guadalupe Street project, the answer was: more than 100 people,” the opinion states.
On October 6, following a recommendation from the inspection team itself, the Pinheiros sub-prefecture sent a letter to the 78th DP (Gardens) “to request the opening of a police investigation for disobedience of the embargo notice.”
Works and “debauchery”
The claim that work continued after the embargo also appears in the AME Jardins appeal and in a document containing a report from a neighbor, banker André Schwartz, CEO of the Genial bank, who reported damage to his property, such as cracks and cracks, addressed to Condephaat.
Amid the controversy, the banker presented a petition to Condephaat in which he called a video published by Adibe’s wife, influencer Cinthya Marques, amid the embargo orders, a “mockery.”
In the recording, published at the end of August (see below), it describes the movements of workers on the construction site. “The concrete mixer is working there. There is a plasterer, there is an electrician. I don’t know the names of everything either,” he said in the video, the link to which was attached to the document.

On her profile which has nearly 300,000 subscribers, Cinthya also shows details about the residence, such as the source of inspiration for its swimming pool. “When I watched the Gianni Versace documentary, I was sure of one thing, that the next swimming pool in my house would be inspired by him. I think Gianni Versace would be proud of me, huh?”
In other sections, the influencer shows the huge garage, closet and bathroom, adding that the artwork used 43 different types of stone. “And the most beautiful stones are the national ones,” he emphasizes.
Irregularity reports
Jardim Paulista, where the lot is located, is a strictly residential area and subject to strict urban restrictions. According to the association, the construction violates the Gardens registration rules by exceeding the maximum heights, by not respecting the mandatory setback margins and by carrying out interventions not planned in the approved project, such as the construction of a second floor in a small building.
AME Jardins also denounced the removal of vegetation on the land, with paving that compromises the permeability of the soil, in addition to damages such as infiltrations, reduced sunlight and invasion of the privacy of neighboring properties.
The action also reports that the work continued despite embargoes from Condephaat (national historical heritage body) and the Pinheiros sub-prefecture.
The judge rules in favor of the association
On the 19th, Judge Mariana Medeiros Lenz, of the 9th Public Finance Court, ordered a series of protective orders, including one which determines the immediate cessation of work or services on the site.
The decision cites previous administrative sanctions, in addition to the finding of “distortion of the Execution Permit” by Condephaat. The judge also specifies that the inspection was shortened, but that it was possible to see from a neighboring property that the “building was advancing beyond the mandatory setback margin and reaching a height greater than the permitted limit”.
“The danger of damage is obvious, given the irreversible nature of the interventions on the classified environmental and urban heritage. The continuation of the works contrary to the administrative embargo orders highlights the risk of consolidating an illegal factual situation, of harming the enjoyment of the cultural and environmental heritage by the community and of causing damage due to the waterproofing of the soil and the removal of protected vegetation”, affirms the judge.
In addition to stopping the work, the judge set a daily fine of R$50,000 for disobedience, establishing a maximum value of R$5 million. He also authorized Condephaat employees to enter the property and carry out a full inspection to “investigate irregularities”.
The ruling also vetoed the granting of “Habite-se” or work completion certificate by the town hall and ordered the existence of the action to be recorded in the property registration at the registry office.
A court decision orders an embargo on work at João Adibe
What does the owner of the mansion say
João Adibe’s lawyers, Daniel Bialski and Fabio Kadi, said that “the work on the house was authorized by all competent bodies and was completed months ago, so there is no imputation of embargo.”
“The property even has an occupation permit, which proves the inadequacy of the allegations presented. In fact, the family has been living there for some time,” the statement added.
The note also indicates that, in a previous action, there was a report prepared by a legal expert which excluded any responsibility of João Adibe for the problems reported by the neighbors. “The document also attests that the damage reported comes from poor conservation.”
According to the press release, an action to the same effect filed by the neighbor saw all precautionary measures rejected by the courts.
