The former advisor was transferred to the Ponta Grossa public prison by order of the STF; the defense contests the measure and demands respect for the provisional measures

The procedure was conducted by the judge Flavia Carvalhodeputy in the office of Minister Alexandre de Moraes, of the Supreme Federal Court (STF). According to g1, after the session, Martins was sent to the Hildebrando de Souza public prison, where he remains under the care of the state prison system.
During the hearing, the guard declared the absence of irregularities or abuse on the part of the agents responsible for executing the arrest warrant at his home. However, Martins noted in his statement that maintaining the prison would constitute illegality on the part of the state, according to g1.
The detention order was issued by Minister Alexandre de Moraes on December 27. The basis for this measure was non-compliance with previously imposed precautionary measures, including the ban on the use of social networks. Filipe Martins was sentenced to 21 years in prison, pronounced on December 16 by the first college of the STF, for the offense of attempted coup d’état.
The former advisor’s defense requested a review of the arrest during the hearing. The assistant judge indicated that such requests must be placed directly in the file for analysis by the STF rapporteur. The lawyer Jeffrey Chiquini denied that his client had violated a court order and pointed out that Martins had been complying with court orders for more than 600 days without any prior warning.
The legal body representing the former advisor informed that it would hold meetings to define the next procedural strategies. The central point of the defensive argument is the absence of new facts which justify the return to the closed regime before the final judgment, arguing that the behavior of the defendant was consistent with the restrictions imposed.
The Paraná Criminal Police confirmed that Filipe Martins’ entry into the prison system followed standard protocols. The Hildebrando de Souza Public Prison, where he was incarcerated, is the detention unit reserved for prisoners in the Ponta Grossa region awaiting judicial definitions or transfer to the definitive criminal execution system.
