Martins’ preventive detention was ordered by Moraes after the former aide-de-camp’s defense was called for clarification on the use of “LinkedIn to search third-party profiles.” Under house arrest, he was banned from using social networks.
According to the STF Minister, “there is no doubt that there was non-compliance with the precautionary measure imposed, since the defense itself recognizes the use of the social network.” Martins was sentenced to 21 years in prison for attempted coup and other crimes, but he can still appeal to the first panel of the court.
Criticizing Moraes’ actions, Chiquini also called the arrest “the beginning of the execution of the sentence”, given that there are still appeals in the former aide-de-camp’s case. Preventive detention is, however, a precautionary measure provided for by Brazilian law and which can be applied even before the criminal action becomes final in the event of non-compliance with another precautionary measure determined by the judge.
The lawyer concluded by announcing that he would meet with the former aide-de-camp’s other lawyers to determine the defense’s next steps and how she would seek preventive detention.
