Moraes claims the defendant violated the ban on using social media; defense claims he accessed client’s LinkedIn to preserve evidence
BRAZILIA – The Federal Court (STF) has decided to maintain the preventive arrest of Filipe Martinsformer advisor to former president Jair Bolsonaro (PL), after the custody hearing held on Friday afternoon, 3. Martins was arrested today in Ponta Grossa (PR), where he was already under house arrest, by order of Minister Alexandre de Moraes.
The custody hearing is a procedure carried out to analyze the legality and necessity of the arrest and to verify the existence of abuses on the part of the police authorities. A judge from Moraes’ office, a member of the public prosecutor’s office and a representative of Martins’ defense participated. The hearing took place by videoconference.
On December 29, Moraes ordered Martins’ defense to clarify within 24 hours a possible violation of the precautionary measures imposed in the criminal action following the coup attempt.
The minister claims that Martins accessed his LinkedIn profile on the same day to search for third party profiles, thus violating the ban on access to social networks determined by Moraes.
To explain to Moraes, Martins’ defense stated that he had not used the social network or made any publications. The lawyers said the profile is under their control to preserve evidence, organize information relevant to the process and audit digital histories.
Martins was sentenced by the Supreme Court on December 16 to 21 years and 6 months in prison for five crimes related to the attempted coup between 2022 and 2023.
