The Federal Police preemptively arrested, this Friday (2/1), Filipe Martins, former advisor to the former President of the Republic Jair Bolsonaro (PL). The order comes from Minister of the Federal Court (STF) Alexandre de Moraes.
Martins had been under house arrest since December 27 and wore an electronic ankle bracelet. He was taken to Ponta Grossa prison (PR).
“Indeed, there is no doubt about the non-compliance with the precautionary measure imposed, since the defense itself recognizes the use of the social network, and the defensive allegation has no relevance in the sense that social networks were used to ‘preserve, organize and verify elements of past information relevant to the exercise of a defense in the broad sense,'” Moraes said in the decision.
According to the minister, “the accused shows a total lack of respect for the imposed norms and constitutionally democratic institutions, because, by using social networks, he violates the precautionary measures applied, as well as the entire judicial system.”
Tuesday (30/12), Moraes asked Filipe’s defense to explain the use of the Linkedin account, under penalty of pre-trial detention.
Martins was sentenced to 21 years in prison during the Nuclear 2 trial. He was banned from using social media. Bolsonaro’s former International Affairs aide has been under house arrest since December 26, after the escape and arrest of the former director of the Federal Highway Police, Silvinei Vasques.
Martins was accused by the Attorney General’s Office (PGR) of managing the actions of the criminal organization that sought to keep Bolsonaro in power.
In addition to house arrest, Martins is expected to follow the precautionary measures imposed by Moraes, which include the surrender of his passport, suspension of firearms possession, ban on visits other than those of lawyers and the use of social media.
According to the order of Alexandre de Moraes, a complaint was received on December 29, added to the file, according to which the former presidential advisor had used Linkedin to search the profiles of other people. The defense had 24 hours to comment on the case.
