The National Court condemned up to eight years and two months in prison for 29 of the 37 natural and legal persons who were tried in Exhibit 6 of the Púnica case for having carried out “corrupt practices”, among … March 2012 and October 2014, for the award of public energy efficiency contracts to the company Cofely in exchange for the payment of bribes to mayors, authorities and civil servants of various municipalities in the Community of Madrid.
In a 611-page judgment, the judges of the first section sentenced the businessman and business advisor to eight years and two months in prison. David Marjaliza for the crimes of criminal organization, aggravated money laundering and continuous crimes of fraud against the Public Administration, prevarication, continuous corruption and falsification of commercial documents by individuals, in relation to ideal medial bankruptcy. It applies the mitigating circumstances of late confessions, excessive delays and compensation for harm.
The judgment also sentences the general director of Cofely to six years and six months in prison, Didier Roger Mauriceand to the commercial director, Constantino Alvarezfor crimes of criminal organization and continuous fraud against the Public Administration, continuous prevarication, continuous corruption and falsification of a commercial document by individuals, in an ideal medial bankruptcy relationship.
For the same crimes and for influence peddling, the Court pronounces a sentence of six years and 11 months against the former commercial director of Cofely, Pedro Garcia Perez.
To these three, as to the other accused, the court also applies the mitigate late confessions, unjustified delays and compensation for damages.
Furthermore, the sentence condemns the former mayors of Parla, Móstoles, Villalba, Torrejón de Velasco, Serranillos and Moraleja de Enmedio.
