
After Minister Alexandre de Moraes, of the Federal Court (STF), transmitted to the General Prosecutor’s Office (PGR) the request from the defense of hacker Walter Delgatti to move to the semi-open regime, the body expressed its opinion this Monday (22/12).
According to the document sent to the Superior Court, the Attorney General, Paulo Gonet, was in favor of the regime’s evolution towards a semi-open regime. Delgatti is currently serving a prison sentence for hacking the electronic system of the National Council of Justice (CNJ) and, at the request of former MP Carla Zambelli (PL-SP), issuing a false arrest warrant against Moraes.
Delgatti was sentenced to eight years and three months in prison, at the Tremembé II penitentiary, inside São Paulo (SP), a place known as the “prison of the famous.” He has already served one year, eleven months and five days of his sentence, or 20% of the sentence, which guarantees the right to progression.

Another factor favorable to the hacker is his good behavior during this period of confinement. “The certificate of prison conduct issued by the penitentiary unit certifies that the re-educated Walter Delgatti Neto presents good prison conduct. In this way, the objective and subjective conditions required to move to the prison regime are met,” said Gonet.
Despite Gonet’s statement, there is no deadline for Moraes’ decision. Zambelli, in turn, convicted in the same case, has remained imprisoned in Italy since July, after fleeing Brazil.
