
The Sobradinho jury court sentenced André Gabriel Ribeiro da Silva to 26 years, five months and 10 days in prison, initially firm, for beating his minor cousin and uncle. The double murder attempt took place in September 2024, in Sobradinho.
André Gabriel brutally attacked his cousin, then aged 7, with punches and kicks, which caused him serious head trauma and multiple injuries. The result of death was not consummated due to the intervention of a third party.
The attacks against the child were classified with four qualifications: gross motive, in retaliation for not having been accommodated by his uncle the previous night, somewhat cruel, due to the brutal beatings, use of a resource which made it difficult for the victim to defend himself and crime committed against a minor under 14 years old.
On the same occasion, after the first attack, the accused attempted to kill his uncle. Again, the crime was motivated by retaliation. The victim managed to defend himself and the arrival of military police prevented the murder.
The popular jury accepted the arguments of the public prosecutor and recognized the materiality and authorship of the two crimes. Analyzing the case, the president of the jury highlighted the increased culpability of the accused who, after the beating, locked the child’s mother and brother inside the residence, preventing any assistance.
The mother had to wait for the police to arrive, who had to break the lock to enter the premises and help her.
The consequences of the crime against the minor were considered serious, since the victim remained hospitalized for more than a month, including a week in serious condition in intensive care.
The accused, who already had a criminal record and a final conviction, had his personality assessed negatively based on a psychiatric report, which showed signs of concealment and manipulation.
André Gabriel responded to the file in prison and will not have the right to appeal while free, he will remain in prison where he is.
