The Council has taken the fight against illegal housing very seriously and one of the measures has been to strengthen the role of the inspector. The ministry wants professionals who will be part of the territorial planning, town planning and sub-inspection body … the accommodation has the category of law enforcement officers and that the dangerous situations are taken into account in their legal regime and in the provision of means of protection.
They are part of problems which are collected in the first draft of a decree (now displayed to the public) to have a regulation on the organization and functions of the Territorial Planning Inspectorate, in force since 2006 and which must now be adapted to the Law for the promotion of the sustainability of the territory of Andalusia (List) and to the regulations in force on housing.
This initiative is in line with the “will” of the government of the Junta de Andalucía which in 2019 urged the ministry to “update the regulations necessary to achieve a sustainable and balanced territory”. The creation of the corps of sub-inspectors by the List implies a greater presence in the territory and, consequently, “better control of illegalities”; but this also implies the need to update the current Regulations which govern the organization and functions of the Inspection, integrating said Body into the organizational structure of the Inspection.
Since 2006, when the regulations in force were approved, the social and economic reality and the forms of illegal occupation of the territory have changed considerably, which “requires an adaptation of the structure, organization and functions of the Inspectorate”.
War against illegal housing
The text argues that it is necessary “strengthen” the control and control of acts and uses of the territory, with “a particular impact” on urban agglomerations that appeared outside of territorial and urban planning instruments, because “they constitute one of the territorial offenses that have the most detrimental impact on the sustainability of the Andalusian territory from the point of view of the security of people and property, environmental protection and social and economic impact”.
“The phenomenon of fragmentation,” continues the draft decree, “implies increasingly rapid processes which require continuous surveillance and presence on the territory of official inspection personnel“. In accordance with this objective, the presence of inspectors and the new sub-inspection corps in the provinces will be reinforced to “guarantee the effectiveness of inspection actions”.
In the regulation, which consists of 57 articles divided into four chapters, two transitional provisions, one repealing one and two final provisions, it is specified that entry into the sub-inspection body it will be as opposed to free. Their level will be between level 22 and level 26 on the civil servant scale.
The future housing law, approved in early December, also provides for the incorporation of sub-inspectors of land use planning, urban planning and housing to strengthen housing inspection tasks. The functions of this new figure will be those of visits and management of digital media necessary for detection, control and monitoring acts and uses of land and habitat constituting counterfeiting; proposals for imposing fines; advice to professional associations; dissemination and awareness work; and the support and technical assistance tasks entrusted by the head of the land planning inspectorate.
