An Argentine judge declared void the so-called anti-picketing protocol promoted in December 2023 by former Security Minister and now Senator Patricia Bullrich, who defended the regulation as did her successor, Alejandra Monteoliva, and the ministry itself, which announced it would appeal the decision.
Federal magistrate Martín Cormick declared the aforementioned regulation void, alleging shortcomings in its formalization and indicated that “people who have been affected by acts carried out by the police and/or security forces” in relation to the protocol “must — individually — report these acts to the criminal justice system, as reported by the Todo Noticias network in the judgment.
Its decision follows a lawsuit filed by the NGO Center for Legal and Social Studies (CELS), which celebrated through the social network
“In this process to demand the unconstitutionality of the protocol, unions, political parties, social movements, indigenous peoples, human rights organizations, environmentalists and many others have come forward. It is a collective triumph,” the organization stressed.
On the other hand, the Executive chaired by Javier Milei has expressed its dissatisfaction with the decision and will present an appeal, as announced by the Ministry of Security in a press release in which it affirms that “without Protocol chaos returns”.
“The protocol is legitimate. It has technical, legal and operational foundations. We will defend it because it is the tool that has restored order, predictability and social peace”, affirmed the ministry, which defends the regulation because, according to it, “it has made it possible to guarantee free movement and that the street belongs again to those who choose to work”.
Thus, the ministry defended that this regulation “does not prohibit, it orders”, since “there is the right to demonstrate, but with order and respect for free movement and the right to exercise commerce”.
The current head of the portfolio, Alejandra Monteoliva, attributed the decision to “old politics” in a message on the social network
The main promoter and supporter of the anti-picketing protocol, current senator Patricia Bullrich, who, through X, took up the same slogan as Monteoliva, also did not appreciate the decision. Likewise, he accused Judge Cormick of positioning himself “always (…) against the government” and maintained that his decision harms “Argentinians who want to work, move around and live in peace.”
