Businessman Elias David Piccirillo, who was on trial for a maneuver in which he planted drugs and a weapon to harm a creditor, left Ezeiza prison on Friday and began serving house arrest. The Federal Correctional Court No. 11, presided over by Judge Sebastian Norberto Casanillo, approved the measure, after the accused presented property worth P500 million as real security for the benefit.
The ex-husband of TV presenter and model, Jessica Serio, offered properties for this amount and the court considered that the financial condition had been met: “To this end, corresponding letters must be issued, in order to initiate the registration of the attachment to respond to the set of title deeds.”
The ban was accepted on 7 November, allowing the order to leave the prison to go ahead.
Authoritarians don’t like this
The practice of professional and critical journalism is an essential pillar of democracy. This is why it bothers those who believe they are the bearers of the truth.
The court order ordered the Federal Prison Service to notify the inmate “expeditiously” and for the transfer to take place on the same day, even without the electronic anklet. “This must be implemented without exception,” the letter to the First Federal Prison Complex, where he was housed, said.
According to spokespersons, Piccirillo was transported to an address located in Serrano, Banfield, where he was held under electronic monitoring. The report submitted to the court established that Matias Piccirillo, the accused’s brother, was the guarantor.
Reasons. Judge Casanello considered that the defendant’s health condition made house arrest applicable. The medical reports included in the file indicate that Piccirillo suffers from “adjustment disorder with depressed and anxious mood” as a result of the quarantine. The expert who evaluated him noted an “attitude of submission and defeat,” accompanied by “spontaneous crying” and “a thought monopolized by despair and helplessness.”
In this context, the ruling considered that there was no procedural risk because “there is no risk of escape and obstruction of the investigation.” For this reason, he considered that the alternative procedure “achieves the purposes of the operation and prevents the worsening of the psychological condition.”
The case. Piccirillo is being tried on charges of forcible kidnapping, aggravated transportation of drugs, aggravated concealment and illegal possession of a weapon. The case links him to a maneuver against Francisco Hoque, a businessman to whom he owed money and who tried to incriminate him by planting drugs and a firearm. Because of this accusation, he remained in pretrial detention in Al-Aziza.
The granted benefit was finalized after several days of negotiations. His defense had insisted since last Monday on obtaining a change in the method of detention and he was responsible for submitting all the documents required by the court. Among the properties offered as collateral were a plot of land in La Pampa and another property located in the interior of the country, both of which were accepted by the court for significantly exceeding the amount required for the bond.
Transportation. While the final procedures were being carried out, América TV’s “A la Evening” program reported live that Piccirillo had left prison and was moving to his new residence. They explained at the session that the three-room apartment in which the procedure would be carried out belonged to his family, a fact that caught the attention of the committee members because of the humble origins of the defendant’s environment.
Following the court’s decision, Piccirillo must remain inside the property, wear an electronic anklet and comply with all obligations imposed by Judge Casanello. The speakers acknowledged that the investigation into the crimes charged against him would continue as long as he remained in detention in this way.
