
One of the defenses in the court case regarding the appointment of David Sánchez, brother of the head of government, to the Badajoz Provincial Council, presented a document of recusal before the judges representing the Badajoz court that must rule on the facts.
The recusal incident document was submitted by the lawyer of Juana Cintas, who was Director of the Human Resources Area in 2017, the date of the creation of the position of “Coordinator of Conservatory Activities” in Badajoz and the subsequent grant to David Sánchez.
Specifically, the lawyer submitted a document of recusal by the president of the court chamber, José Antonio Patrocinho, and the rapporteurs Emilio Serrano and Dolores Fernández.
These judges have already rejected “on a very broad and unusual grounds” the appeal brought by this defense against the prosecution order in the case against Sintas – for his alleged participation in the commission of an administrative evasion offense – and the rejection they made of the expert evidence, as detailed in the memorandum.
In the view of this defence, the fact that the judges used various expressions, such as “clearly” to support their rejection, “reveals, beyond any doubt, the presence of already strongly learned bias”; Or “attempted justification” and even “harmful purpose” involve “prejudging the subjective element of the crime” charged.
“There is no neutral position with regard to the positions of the parties in the process,” the lawyer explains, asking “how this defense can face an oral trial procedure with sufficient guarantees of impartiality, if by September 23, 2025 – the prosecution asserts – issues that clearly affect the objective and subjective elements of the criminal offenses with which he is charged.”
The appointment trial of David Sánchez, brother of the head of government, will be held in the Regional Council of Badajoz, from 9 to 14 February 2026.
The Court of Badajoz issued a notice procedure for oral trial in the above-mentioned case, in which the former president of the Badajoz Provincial Council, Miguel Ángel Gallardo, leader of the PSOE of Extremaduran and candidate for the presidency of the council in the early elections in this autonomous community, also appears as a defendant.
The trial, whose proceedings were supervised by the President of the Instruction Court 3 of Badajoz, Beatrice Biedma, will take place in the Badajoz Court.
