Bruno Henrique will finally be tried on Monday by the Full Court of Justice for Sport (STJD). The Flamengo striker was sentenced in the Court of First Instance, at the beginning of September, to a 12-match ban and a fine of 60,000 Brazilian reals to force him to receive a yellow card for the benefit of bettors in 2023. But the defense appealed and was acting under the influence of the ban. Today’s session begins in downtown Rio de Janeiro at ten in the morning, and its future may be decided.

The number 27 was found guilty by a majority vote (4 to 1) in Article 243-A of the Brazilian Code of Justice for Sport (CBJD), which speaks of “acting in a manner inconsistent with sporting ethics in order to influence the result of a match.” The card in question was received on November 1, 2023, in a match against Santos, at Mane Garrincha, in Brasilia, for the Brazilian League.
In addition to Bruno Henrique – also charged in the General Court – four amateur athletes who bet on that game were convicted: the brother of the Flamengo player, Wander Nunes Pinto Junior (12 official match ban), as well as Claudini Vitor Muschietti Basan (14 match ban), Andril Siles Nascimento dos Reis and Douglas Ribeiro Pena Barcelos (both with six match ban).
Both the defense and the prosecutor’s office can appeal the decision. While one side wants all convictions overturned, the other side wants the player to serve a longer sentence – the maximum is two years – and for it to apply to all competitions. For the penalty to be applied in Libertadores matches, for example, the CBF needs to submit a request to FIFA, directing the entity to amend the penalty.
Bruno Henrique, Andrile and Claudini had undergone a full trial that was scheduled for the last week of October, but the Court of Justice and Equality postponed all hearings due to the massive police operation that took place in Rio de Janeiro, in the Penha and Alemão complexes.

The plenary is the final sporting arena within the country, but depending on the outcome, the parties can take the case to international bodies, such as the Court of Arbitration for Sport (CAS).
Why is Bruno Henrique on trial?
Bruno Henrique was accused of sharing advance information about the yellow card he received in a match against Santos at Mane Garrincha Stadium, in Brasilia, on 1 November 2023. The move could have benefited his brother Wander, who would have passed the information on to friends.
In addition to the duo, Claudini Vitor Muschietti-Bassan, Andril Reis and Douglas Barcellos were also found guilty and convicted by the Court of Justice and Equality. Ludimila Araújo Lima, Wander’s wife, and Poliana Esther Nunes Cardoso, Bruno Henrique’s cousin, were also implicated, but both were out of the court’s sights.
The First Disciplinary Committee of the STJD formed a majority (4 to 1) to convict striker Bruno Henrique, of Flamengo, in the first instance, in Article 243-A of the Brazilian Code of Justice in Sports (CBJD) for forcing him to receive a yellow card and benefit from bettors in 2023, in a match against Santos, in Mane Garrincha, for the Brazilian League. - Auditor Guilherme Martorelli stated that Bruno Henrique revealed that the club ordered him to receive the yellow card, which is not considered a loss to the institution. Thus, he was acquitted in 243. As for 243-a, he pointed out that game strategy cannot be confused with manipulation, and he also acquitted him. However, he was convicted under Article 191, with a fine of R$100,000.

On appeal, the Public Prosecutor’s Office highlighted that Bruno Henrique obtained a personal benefit from the information, by informing his relatives that he would receive a third yellow card; And that there is a loss for the club, as the widespread repercussions affect the player’s value in the market.
How long has Bruno Henrique been investigated?
This case has been investigated since August last year by the Federal Police and the Public Ministry of the Federal District, when three bookmakers discovered abnormal volume and movements of bets on the attacker’s cards in that match.
In November, the player’s cell phone was searched and confiscated, but the Court of Justice and Equality closed the case. In April this year, French police charged Bruno Henrique with embezzlement and fraud in a sports competition. The agency was able to access conversations between the player and his brother, proving that the card information was expected. In June, the MP convicted him. If sentenced to the maximum penalties in the combined field, the player could be sentenced to up to 17 years and eight months in prison.
