The athlete’s defense requested that the lawsuit be dropped by statute of limitations, but the court rejected this thesis. Now, the public continues to vote on the dosage measurement in the athlete’s sentence.

The athlete’s defense claimed that the public prosecutor’s office took longer than allowed to file the complaint against Bruno Henrique. According to the Brazilian Sports Justice Law, the deadline is 60 days after the investigation is opened.
The thesis is based on the date of the manipulation episode, November 1, 2023, in the Flamengo x Santos match. But in addition, the defense also assessed that the deadline could be considered from the moment the court was notified by CONMEBOL about the suspicion, on August 2, 2024.
Bruno Henrique was denounced by the STJD on August 1st of this year. On 4 September, he was given a 12-match suspended sentence and fined R$60,000 by the STJD’s First Disciplinary Committee. But he appealed the decision, and despite his conviction, he managed to escape punishment.
Remember the case
- Bruno Henrique, who was already suspended with two cards, fouled Sotildo, when playing for Santos, in the attacking area. Referee Rafael Clyne issued a yellow card. Then the player complained blatantly and ended up being sent off.
- On August 1, 2025, the STJD Prosecutor’s Office convicted Bruno Henrique and four other people for tampering with sports betting results. According to the accusation, the Flamengo striker committed arbitrary mistakes in order to be punished and bettors would benefit.
- Bruno Henrique is listed under Article 243 (paragraph 1) and 243-A of the Brazilian Code of Justice for Sport (see below).
- Bruno Henrique was also indicted by the Federal Police in April after he was charged with sports fraud, which is denounced in Article 200 of the General Sports Code – defrauding by any means, or contributing to fraud, in any way, as a result of a sports competition or an event connected to it.
- In addition to the player, the accused body convicted four other amateur athletes: the brother of the Flamengo player, Wander Nunes Pinto Jr., as well as Claudine Vitor Muschietti Basan, Andril Siles Nascimento dos Reis, and Douglas Ribeiro Pena Barcelos (all friends of Wander).
- The Flamengo athlete will also be sentenced by the Court of Justice of the Federal District and Territories (TJDFT). Bruno and his brother Wander – who was also the target of a police force operation in November last year – exchanged messages on August 29, when Wander questioned his brother about his suspension from the Brazilian league. The indictment was revealed exclusively by Metropoles.
- As for PF, messages exchanged indicate that Bruno Henrique has given his brother advance information that he will receive a yellow card in the clash against Santos.
Previously, Bruno Henrique was listed in Articles 243 (paragraph 1) and 243-A of the Brazilian Code of Sports Justice. check it out:
- Article 243: Intentionally acting in a way that harms the team he is defending. § 1 If the violation is committed in exchange for payment or the promise of any benefit, the penalty will be a suspension of three hundred and sixty to seven hundred and twenty days and deletion in case of repetition, in addition to a fine of R$100 to R$100,000.
- Article 243-A: Acting in a manner contrary to sporting ethics with the intention of influencing the outcome of a match, race, or its equivalent. Punishment: a fine ranging from 100 Brazilian reals to 100 thousand Brazilian reals, and a suspension of six to 12 matches or competitions or its equivalent, if practiced by an athlete, even if he is a substitute, coach, doctor or member of the technical committee, or for a period of one hundred and eighty to three hundred and sixty days, if practiced by any other person, naturally subject to this law; In the event of a repeat violation, the penalty will be deletion.
Even in the court of first instance, Bruno Henrique was acquitted under Article 243, but convicted under Article 243-A.
