When filing a complaint against eight suspects involved in the murder of former Attorney General Rui Ferraz Fontes, prosecutors at the Public Ministry in São Paulo stated that there were insufficient elements to prove the involvement of five other people also accused of committing the crime. Therefore, the prosecution requested that the investigations continue.
According to the complaint, the execution could have been carried out in retaliation by the First Metropolitan Command (PCC) for the actions of Rui Ferraz Fontes in the São Paulo Civil Police. But the MPSP did not specify who the leaders would be.
The five suspects who were not charged with murder were released last week by court decision. Contrary to the Homicide and Personal Protection Team’s request, the judge chose to grant the investigators temporary freedom and impose other precautionary measures, such as the use of an electronic ankle bracelet.

Among the beneficiaries were Dahsley Oliveira Pires, who after the crime allegedly transported a rifle from Praia Grande to São Paulo, and José Neldo da Silva, who was arrested with a pistol in one of the houses used by the group.
In addition to these, Rafael Marcel Dias Simões, Jaguar’s car, who, according to the police, was linked to the PCC and maintained contact with the group, were also released, as were two men who allegedly assisted in his escape: Luiz Henrique Santos Batista, fouvao, and Danilo Pereira Pena, mathematician.
The prosecution said in the complaint that in the Al-Dahsali case, there is evidence that she was part of the criminal organization, but her participation took place after the crime. They added: “Therefore, there are still no elements capable of suggesting their commitment to the plans set by the First Command of the capital.”

They added: “But there are ongoing investigations, and in the end new evidence may emerge that confirms or refutes the hypothesis that this crime was also committed by the defendants.”
In the case of Jose Neldo, the complaint says that despite the photos in which he appears carrying a weapon, his relationship with the rest of those investigated is unclear.
Regarding Luiz Henrique Santos Batista, Rafael Marcel Dias Simões and Danilo Pereira Pena, the complaint indicates that there is insufficient evidence to link them to any of the crimes investigated.
Recruiter denied being PCC ‘disciplined’
According to investigations, the group that carried out the plan to kill Rui Ferraz Fontes, on September 15, in Praia Grande, was recruited by Marcos Augusto Rodriguez Cardoso, known as Viel, Pan, or Penelope Charmosa. According to the police, during the first interrogation, he said that this would be “discipline” from the district court. Eight days later, in a second interrogation, he denied this information, saying that he had no connection to the criminal organization.
Using fingerprints found in the cars used in the crime and text conversations, police were able to identify other suspects. However, there are no details about the alleged direct involvement of each of them in the murder.
For example, Felipe Avelino da Silva, Mascherano, and Flavio Henrique Ferreira de Souza left fingerprints on the Jeep Renegade used in the crime. Police were unable to determine when they were at the scene, either before or during the killing.
Identified as the possible shooter, Umberto Alberto Gomez was identified based on genetic material found in homes used by the criminals in Mongagua and Praia Grande. He fled São Paulo and died on September 30 in Curitiba, after an alleged confrontation with São Paulo and Paraná police.
Luiz Antonio Rodriguez de Miranda, known as Gao, according to the police, was the driver of the car used in the execution, in addition to being responsible for asking Dahsley to return the gun to São Paulo.
The other defendants are the owners of the houses used by the criminals, and they had cooperated in some way in the execution. One of them is Paulo Henrique Caetano de Sales, PH, who has also been identified as having similar physical characteristics to that of one of the pitchers. In addition to him, William Silva Márquez and Cristiano Alves da Silva also offered properties to the group.
