— The law specifies that payment must be made in November. Since bank compensation is not carried out on weekends, the deposit must be made on Friday (28th), because the following Monday will be another month – explains lawyer Sandra Morais, specialist in labor law.
For those who get the benefit, payment will be made on the same day as, say, Black Friday, a date that is already integrated into Brazilian retail and used by many consumers to anticipate Christmas shopping. But Sandra warns: There is no specific time for the first installment to be deposited into the worker’s account. So you have to pay attention to your expenses.

The thirteenth salary is a right guaranteed by law to holders of official contracts, retirees, and retirees of the National Social Security Institute. The official payment calendar expects the first payment to arrive in the worker’s account by November 30. The second batch is scheduled to drop by December 20.

Who gets the thirteenth salary?
All workers who have a formal employment contract, whether in the private sector or the public sector, can receive the wage. INSS pensioners and pensioners also get this benefit. Now, temporary workers, interns and freelancers are not eligible.

The law specifies that employees hired under the Consolidation of Labor Laws (CLT) scheme must have a contract with the company for at least 15 days to receive their 13th salary. Employees who terminate their contracts before December, except for good cause, are also entitled to a thirteenth salary proportional to the time worked, which must be paid with termination.
