The President of the Supreme Court of Justice, Minister Hermann Benjamin, denied the habeas corpus and maintained the detention of banker Augusto Lima, former partner of Daniel Forcaro at Banco Master.
The decision was issued on Tuesday night (11/25).
Augusto Lima is being investigated in Operation Zero Compliance, which is investigating alleged fraud worth R$12 billion in credit portfolios negotiated by Banco Master. He has been in prison for eight days.
The President of STJ understood that the Supreme Court was unacceptable because of precedent No. 691, according to which the court does not have the right to issue an injunction against the unilateral decision taken by a judge who rejected an injunction. In other words, Syrians’ action for truth and justice in this case would be premature.
