STF concludes trial that makes Eduardo Bolsonaro accused of coercion

The First Chamber of the Federal Supreme Court (STF) accepted the complaint filed by the Public Prosecutor’s Office (PGR) and made Federal Representative Eduardo Bolsonaro (PL-SP) charged with the crime of coercion in legal proceedings. The trial ended on Wednesday (11/26) with a unanimous decision.

Eduardo is accused of coercing the Supreme Court in the context of the criminal case that convicted former President Jair Bolsonaro (PL), and other allies, of the coup attempt after the 2022 elections.

Minister Alexandre de Moraes, the rapporteur of the case, considered that there was sufficient material evidence and evidence of authorship in the behavior of the representative – who would have moved in the United States to impose sanctions on the Brazilian authorities and impose customs duties against Brazil.

“The serious threat was embodied by the formulation and receipt of sanctions from the Government of the United States of America, with the application of export tariffs to Brazil, the suspension of visas for several Brazilian authorities in the United States of America and the application of the effects of the Magnitsky Act to this Minister in charge of the report,” Moraes said in his vote.

The Public Prosecutor of the Republic, Paolo Jeunet, said in the complaint that Eduardo “has repeatedly committed himself to subordinating the interests of the Republic and the entire society to his personal and family plans.”

The PGR complaint was admitted under the provisions of Article 344 of the Brazilian Penal Code, which provides for coercion during the process. The text of the article states that coercion occurs when “violence or serious threats are used, with the aim of achieving a personal or other interest, against an authority, party, or any other person acting or called upon to interfere in a judicial, police, or administrative process, or in an arbitration court.”

Now, the Special Criminal Court will open a criminal case against the MP, and the procedural investigation phase will begin, where the prosecution and defense will have the opportunity to present evidence and hear witnesses.
