The House of Representatives approves a draft law allowing the army to carry out public works without a tender policy

According to the approved text, the exemption may be applied in cases of works that have been stopped, abandoned or delayed for more than one year, in strategic infrastructure works, as long as they cost more than 15 million Brazilian reals.

Work on strategic national, state or municipal development projects, including road, railway and metro infrastructure, waterways, ports, airports, power generation and transmission, will also not require bidding.

According to the text, federal, state and municipal public bodies will be able to enter into a partnership with the military when the ability to carry out related engineering works and services is demonstrated and “the ease of entering into the partnership is demonstrated.”

“The technical competence, competence and integrity of the Brazilian Army in the execution of engineering works and services are widely recognized by Brazilian society. Allowing the Force to take over the implementation of paralyzed, abandoned or delayed public works constitutes an effective and timely measure, capable of ensuring economy, speed and smoothness in the use of public resources, as well as ensuring the resumption of projects of high social and strategic importance,” the rapporteur says in the opinion.

The project also specifies that business implementation partnerships between federal, state, and municipal public agencies and the military should include activities aimed at training and qualifying embedded youth, with the goal of training soldiers specialized in business and engineering services.
