
Rep. Paulo Azzi (Uniao-BA), Chairman of the Chamber’s Committee on Constitution and Justice (CCJ), said this Wednesday that the impeachment of Representative Alexandre Ramajim (PL-RJ) should go through a vote in the Committee as well as in the plenary session.

Izzi said that he has not yet spoken with Chamber President Hugo Motta about the matter, but that is supposed to happen in the next few days.

According to the constitution, when a member of parliament is sentenced to more than 120 days in prison in a closed system – as is the case in Ramajim – the Chamber’s Board of Directors can declare the loss of mandate through a simple administrative procedure, without the need to vote in the plenary session. This is the path that was adopted, for example, in 2017, in the case of then-MP Paulo Maalouf, whose term was immediately declared vacant by the Council.
However, there are fears among government supporters that the President of the Chamber will repeat the measure recently applied to MP Carla Zambelli (PL-SP). In this case, Motta did not follow the administrative route and decided to send the process for analysis by the Constitution and Justice Committee, which opens a longer process: the report, the possibility of appeal, long deadlines and, ultimately, the need to vote in plenary, which requires 257 votes to confirm the accusation.
Ramajim is in the United States, and Moraes has already ordered his preventive detention.
