
A daring robbery inside a residential complex in Aguas Claras caught the attention of residents and sparked discussions about security and liability of condominiums. Surveillance cameras captured, in great detail, the actions of a pair of thieves who entered the building’s premises. The crime is being investigated by Police Station No. 21 (Taguatinga Sul)

Wearing hoods and pretending to use their cell phones, they walk around the garage in an unobtrusive manner. Reviewing the security cameras revealed that the theft occurred last Thursday (11/22), and was carried out by the couple recorded in the pictures. The damage, according to its owner, is significant.

The incident reignited controversy among residential unit owners about the limits of residential unit liability in such cases. Similar situations were frequent and required more attention, explains lawyer Priscilla Felzemburgh, specialist in condominium and real estate law and member of Karpat & Felzemburgh, who was requested for this article.
According to the expert, the jurisprudence is clear: a residential complex can only be held liable for thefts in units or common areas if there is an express provision in the agreement, except in exceptional cases, in which the guilt of the residential complex is proven unambiguously. “When there is camera recording and there is a failure to detect invaders, it is important to analyze whether there was an omission in surveillance duty,” he says.
The lawyer stressed that the incident reveals the need for a continuous review of security practices: “Residential units must assess risks, modify protocols and strengthen preventive measures. This reduces losses and reduces potential legal liabilities.”
