Rage at the beach: Prime minister in swimsuit shoots bather and attacks police officers

The arrest of military police lieutenant Leonardo Athela Rodríguez Borghi, 32, led to the mobilization of civilian and military police in Ilhabela, on the northern coast of São Paulo, after a series of attacks against a swimmer, two prime ministers and a civilian police officer. This case occurred in Praia do Seno, late in the afternoon of Tuesday (25/11).

Testimonies collected by civilian police describe episodes of progressive violence, which began when the officer, who was off duty and wearing only a swimsuit, became angry when he saw a 40-year-old bather smoking a marijuana cigarette.

The victim reported that he was at the beach with a friend when the lieutenant approached and showed discomfort. The woman, who works as a waitress, said: “He started physically attacking me and threw my (marijuana) cigarette away. Then he shot me in the foot and threatened to kill me.”

According to Corporals Paulo Henrique Washnieski and Fernando Felipe Camargo Lourenço, who responded to the incident, the lieutenant seemed calm at first, as he was sitting on the sand, but he soon began to act aggressively. Lourenco said that when trying to understand what happened, the off-duty officer “started attacking the police officers, and I changed emotionally,” demanding his release and ignoring orders.

The officer’s defense location has not been determined. The field remains open for demonstrations.

“bloodshed”

Sergeant Milton Schneider-Balestrini, who also intervened in the situation, reported that he was “hit in the head” by Burgi while he was maintaining the suspect’s vehicle. The violence occurred after Balestrini prevented the officer’s wife from using the car, allegedly to go to the pharmacy. The vehicle in which the lieutenant’s weapon was allegedly hidden was kept for inspection.

“After the attack, (Leonardo Borghi) spat in my face (actually at the police station),” Palestrini said. Prime Minister Sergio Neves do Prado also confirmed the attack on his colleague. Civilian police records also show that the lieutenant, who was already in handcuffs, threatened area police officers. “He said he was a murderer, that he would return to the unit, and that there would be a lot of bloodshed.”

Civilian police officer Leonardo Gomez Mariano stated that he was beaten when he was leading the prisoner into the police station. He explained: “He kicked me in the chest and neck when I was already detained, suddenly, which required intervention.”

Lieutenant Burgee’s companion, who was with him on the beach, admitted that there had been a quarrel between her companion and the waitress, but she said that she had not witnessed a physical assault. But she admitted that they both drank alcohol and that her husband was on antidepressants. Her story contradicted the statements of the waitress and her friend, who reiterated that the officer had acted violently from the beginning “for no apparent reason.”

Police Chief Caio Fresato Nunes de Miranda considered that there was sufficient physical evidence and evidence of the crimes. The initial report indicates the lieutenant’s .357 caliber pistol was seized along with the ammunition that had already been fired.

Without warranty

The delegate determined the arrest in the act to be due to actual threats, discharging a firearm on public roads, qualified resistance, and physical harm against law enforcement officers. The decision stated that “the maximum penalties when taken together exceed four years,” which made bail impossible and led to the lieutenant being placed in prison, at the disposal of the court.

The Civil Police opened an investigation and also reported the case to the Prime Minister’s Department of Internal Affairs, due to the attacks on police officers Balestrini and Prado, which were committed “in the exercise of their duties.” According to the report, the bather’s behavior did not constitute a crime, as it was possession of marijuana for personal use, after the decision of the Federal Supreme Court.

The Secretariat of Public Security (SSP) told CapitalsIn a note, the lieutenant’s weapon was seized. He remains detained in the Romao Gomez military prison, north of São Paulo. He added that the military police had also launched an investigation “to determine the facts and their responsibilities.”

The lieutenant was charged with menacing, felonies, discharging a firearm, causing bodily harm and resisting.

After the investigation is completed, the lieutenant “may” be prosecuted at both the criminal and administrative levels, where he may “be punished with disciplinary measures.”
