
Businessman Rene Nogueira Jr., who admitted to shooting street cleaner Ludimir de Souza Fernandez in August, said during the hearing in the case that he took the gun from his wife, police officer Ana Paula Balbino, while she was showering because she was afraid of a former partner. The executive did not answer questions during questioning, but gave his account of what prompted him to give up the weapon. He stated that he was threatened, and after his arrest, he was forced to confess to the crime.

The crime occurred on August 11. Ludimir was shot and died from his injuries after the alleged traffic brawl. Eyewitnesses said that Rene was upset because he could not drive his car while the street sweeper and his colleagues were collecting waste in the neighborhood. He threatened the garbage truck driver before shooting at the professionals and wounding the victim. The businessman was arrested hours later, at an upscale gym in the capital of Minas Gerais state.
Rene is charged with triple murder, threats and procedural fraud. This week, the Minas Gerais court held preliminary hearings and trial sessions in this case. Now, you have to decide whether to put the executive on trial by jury.
At the hearing, in which he participated via video, Rene claimed that he took the gun because, he said, he had received threats from a former partner who said he had ties to Jogo do Becciu.
She filed a police report regarding the threats directed at her (the former partner). She told me that she had an affair with Jogo do Picho, that she had received bags and bags of money, and that if she tried to go ahead with anything, she would do something against me. (…) When she told me this, I talked to my wife (…), she advised me: ‘Do everything right, go to the police, record the threat.’ But we were worried.”
Rene said he went out armed because that day was one of the first times he personally worked for a new company. On the way, he said, he passed through the city where his ex-partner lived, according to the full statement obtained by the O Tempo newspaper.
– This was the motivation for me to steal the gun. Ana Paula was taking a shower. It has nothing to do with the topic. “I actually did that that day, for fear of confronting those who threatened me.”
The businessman denied committing the crime because he was disturbed by the delays and traffic caused by the actions of street cleaners.
– I have not been involved in any accidents, perhaps not even a fine. I will not, under any circumstances, fight with anyone for standing behind a truck for a few seconds. never. (…) I was alone in the street that day for half an hour. (…) This is not why I do anything – he claimed.
Prosecution witnesses were heard Tuesday in the first summary jury court, at the Lafayette Criminal and Family Forum, in central Belo Horizonte. Defense witnesses were heard on Wednesday.
Thiago Lenoir, who represents the victim’s family, said he was “completely convinced that justice will be done.”

All the elements of the crime have been clearly stated, and it is expected that at the end of the investigation, the accused will be pronounced guilty and sent to the jury court – highlighted Lenoir.

The businessman’s wife, Minas Gerais civil police delegate Ana Paula Balbino, was indicted for malfeasance, failure to act despite knowing that her husband was suspected of the crime, and illegal possession of a weapon, as the pistol used in the case was hers. She was not charged because the Prosecutor’s Office assessed that the terms of the non-criminal prosecution agreement could be negotiated.
When filing the complaint, the public prosecutor requested that Rene be tried by jury court and that he pay at least R$150,000 to the street sweeper’s family, if convicted.
Messages obtained by police showed that he ordered the woman to hand over another weapon to investigators, other than the .360-caliber pistol used to shoot the street sweeper. The MP considered that the crime was committed for flimsy reasons, on public roads, and using an illegal weapon. Experience proved that the weapon belonged to Ana Paula. According to the Civil Police of Minas Gerais, the delegate learned that her husband had repeatedly used her weapons.
The businessman showed himself in video clips carrying weapons and a woman’s badge. The investigators who charged him with murder maintained that the executive was “fascinated” by the weapons and his accomplice’s position.
