
Defense lawyers for Jair Bolsonaro (PL) filed the so-called injunction against the decision that led to the former president being sentenced to 27 years and 3 months in prison in the Supreme Federal Court (STF). In the document, on Friday (11/28), defenders claim that Moraes committed a “judicial error” by declaring the measure final.
“A decision that provided the final and non-appealable decision in the criminal case while the deadline to oppose the violating bans was still in place – even though it had been passed by the First Commission – is a judicial error and should be reconsidered,” they said in the article.
The defenders also add: “With the utmost respect, it is not appropriate to say that an appeal that has not even been filed is a delay. In fact, without knowing its reasons, it has been classified as a delay.”

Furthermore, the defense requests recognition of the vote of Minister Luiz Fuchs, the only dissenter in convicting Bolsonaro:
“The blockading state requests that existing contravening bans be known and stipulated, so that in the event of an unsuccessful vote cast by senior minister Louise Fuchs, the criminal procedure would be declared invalid in principle,” they added.
