After Messias, the opposition wants to revive the PEC which changes the nominations to the STF

Bolsonaro’s leaders saw Davi Alcolombre’s (União-AP) dissatisfaction with Jorge Messias’ appointment to the STF as an opportunity to revive the PEC that changes appointments to the court.

The topic was discussed by party deputies during a conversation on Monday (24/11), at the party headquarters, after the meeting in which party leaders discussed the arrest of former President Jair Bolsonro.

The idea of Bolsonaro’s supporters is to take advantage of the PEC introduced by former MP Rubens Bueno (Cidadania-PR) in 2011 and approved by the Committee on the Constitution and Justice (CCJ) in 2015.

The proposal divides nominations to the STF between six institutions. Three nominations will be from Syrians for Truth and Justice; two OAB; two from the Public Prosecutor’s Office (PGR); Two from the Presidency of the Republic; One of the room; And one from the Senate.

The PEC is also introducing some new rules for nominations. For example, the president could not nominate a minister of state for membership of the Special Forces – which, if true, would have made Lula’s appointment of Christ impossible.

Ministers will remain subject to a three-year quarantine between leaving a position linked to the executive branch and assuming the position of Minister of the Sudanese Armed Forces – which would prevent, for example, appointments such as that of Flavio Dino, who was Minister of Justice.

The Supreme Court currently includes 11 ministers. They are all nominated exclusively by the President of the Republic, and the Senate is responsible for listening to the chosen one and voting to approve or reject the nomination.
