STF orders PCO chief to compensate Kim Katagwiri for calling him a ‘genocidal’ and ‘Nazi’

The STF ordered the head of the PCO, Rui Costa Pimenta, to compensate the MP Kim Katagiri (Uniao-SP) for calling him a “genocide,” a “Nazi” and a “clown.” He will have to pay R$10,000 in compensation for moral damages,

The MBL-linked parliamentarian won an extraordinary appeal by the PCO leader to the Supreme Court, which deemed the remarks offensive to the MP’s honor.

The court recognized that Pimienta exceeded the limits of freedom of expression “contrary to his social purpose, good faith and good habits.” According to the decision, there was a violation of rights, as he violated the public demonstration and insulted Katagwere’s honor.

The statements came in February 2024, after Katagiri filed a class-action lawsuit in federal court asking the union to stop transferring resources to UNRWA, the United Nations relief agency for Palestinian refugees. In the lawsuit, the representative alleged the possibility of transferring funds to Hamas.

After losing the first case, Pimenta appealed the ruling and was denied. The case then reached the STF, under the report of Flavio Dino, which also rejected the appeal.
