STF and manipulation

The case of full-back Igor Karius reached the International Federation of Association Football (STF) after the athlete’s defense appealed the decision of the Supreme Court of Justice (STJ). The rapporteur of the case, Minister Andre Mendonça, had rejected the defender’s request in August, but the trial was halted after Gilmar Méndez asked for it to be reconsidered.

In a vote released on Tuesday (2/12), Gilmard disagreed with the rapporteur and confirmed that the athlete had been suspended by order of the Supreme Court of Justice for Sport (STJD). The Minister also confirmed that the aforementioned manipulation did not affect the outcome of the match. Therefore, he agreed to a subpoena before the defence.

Minister Dias Toffoli followed the dispute, and the trial ended 2 to 1 – Minister Luiz Fuchs was not part of the panel from the beginning of the trial, and Minister Nunes Márquez was not present.

According to the complaint filed by the Public Ministry of Goiás, Karius received R$30,000 before the match against Atlético MG, in the 2022 Primera Division, to be punished with a yellow card. At the time, he was wearing the colors of Cuiabá.

Next Thursday (4/12), the Third Criminal Commission of the Court of Justice for the Federal District and Territories (TJDFT) will rule on the appeal filed by the Public Ministry of the Federal District and Territories (MPDFT) requesting a review by the court, which did not receive the complaint filed regarding allegations of embezzlement crimes against striker Bruno Henrique, from Flamengo.

The MP also requests a review of the court’s decision that rejected the institution’s request regarding the handling of precautionary measures such as the suspension of all economic or financial activities related to sports betting and the payment of bail of R$2 million.

On July 25, Bruno Henrique and his brother, Wander Nunes Pinto Jr., became indicted for sports betting fraud. However, Judge Fernando Brandini Barbagallo partially accepted the MPDFT complaint.

The representative’s appeal reiterates the initial submissions of the complaint. The arguments are that precautionary measures must be specified, because by maintaining access to the traffic of the sports betting business of the accused, there is the possibility of signing contracts with betting houses and the risk of new attacks.
